Is there a statue of limitations on filing an income tax return?

For filing, no.

For a refund, yes, three years from the due date. (2005, 2006. 2007 all are OK for a refund).

There is a 10 year statute for collecting the tax due, from the time it is filed. Some things extend the statute.

If the IRS suspects fraud, there is no statute whatsoever.

Mathew
No, the IRS can require you to file a return for any year that you had income enough to be required to file. I have done a number of them over ten years past the due date. Generally, as a practical matter it is difficult for the IRS to prove you had income much beyond ten years and thus require that you file a return but they could.

No. The statute of limitations for collecting doesn't start running until a return is filed, so if you didn't file, they can go back as far as they want to

well you can only get refunds going back 3 years, but have to pay taxes owed, plus penalties and interest

Jss
1. You must file your tax return if you are required to file.
2. If you owe taxes, you will also pay interest and penalty.
3. If you have a refund, you will not get it till you file. To get a refund you must file your return within three years.

No. There is no statue of limitations on filing a Federal Income Tax Return. The Internal Revenue Code allows the IRS to file a return for you for any unfiled year. That means if you have a return that was due 30 years ago the IRS could still file a return for you. Not to scare you now the IRS usually will only go back 6 or 7 years.

If you don't file a return you do not start the clock running on the IRS Statute of Limitations for collecting the tax liability. The IRS has 10 years from the date you file or the date the IRS files or adjusts your return to collect any tax liability. There are some things that extend the collection statute, an Offer In Compromise or an Bankruptcy, etc.

At the federal level, there is no time limit. There is a three year time limit to claim a refund but if you owe, there is no time limit. If the IRS has reason to believe there was any fraud involved, there again is no time limit.

At the state level, all states are different but most are close to the federal time limits or even exactly the same.
