Unfortunately there is no way to check in advance. Don't let him get away with it. Work with the IRS. If your daughter lives with you and not your ex during the entire year, they would let you have the deduction before your ex no matter when you file. Too bad you let him get away with it last year. |

Sorry, about the only way you can find out is to try to efile your own return claiming her and see if it's accepted or not. If it's rejected though, that doesn't mean you can't claim her, it just means you'd have to mail it in. If he also claimed her you will BOTH get a letter from the IRS about it - so if you get one, don't run out and amend your return and drop the exemption, that's something HE has to do. If he doesn't, the IRS will do it for him.

Unforturnately there is no way to find out ahead of time. Once you file, the IRS will let you know that the SS # has been used already. |

Not really anything you can do EXCEPT file as early as you can and beat him to the punch!

if IRS later comes back and says something, show them the judge's order and last year's papers -- they'll go away and hassle your ex- instead. |

If the child resides with you and you have proof that u r the only one who is taken full responsiblities for this child--U have no worries...IF he is filing and showing on his taxes that he is..he will get caught....HE CAN ONLY SHOW WHAT MONIES HE PAYS FOR HER SUPPORT--AND IF HE ISN'T PAYING SUPPORT...GO TO COURT AND GET IT...THEN INFORM THE IRS OF WHAT HE IS TRYING TO DO....YOUR TAXES SHOULD 'NOT ' BE REJECTED AS LONG AS YOU HAVE PROOF OF FULL CUSTODY... do not let this butthead have his way..contact this IRS and get your money that is due to YOU!!!! |

No way other then to file and see what happens. Also, if he did not have the legal right to claim your daughter last year amend your taxes to claim her. When the IRS contacts you give them the proof. |

i am in the same boat. as soon as i got all my paperwork i headed to h&r block and hoped the sneaky a$ $ did not file yet. i cannot believe he is behind in child support and tried to pull that ish ohh my bad this is not the rant section, sorry i digress. . . |
