RT | Is this considered IRS Fraud? What should I do? |
I overheard my sister speaking to a friend who lives in Spain, she moved about a year ago.
Her friend mentioned that she filled her 2007 taxes and will be getting a refund over 5,000 dlls + the stimulus checks, she claimed 3 dependants (husband and 2 children) + earned income credit.
I am a bit confused, she did not work at all in 2007, but is receiving rent on her house in USA, which she declared as income, but since this is less than 10,000, this puts her in a low wage and able to file for earned income credit.
She filled as if she still lived in USA, with her parents address, but has been living in Spain since Dic. 2006, her husband works in Spain but she stays at home with Children.
Also she just received the stimulus check at her parents.
Is this legal?, I find it disturbing, if the goverment is giving money to people how are not even going to spend it in the USA.
Can anyone who knows about taxes, please explain to me how she is doing this and it it is correct? |

She may have other income you don't know about such as stocks, investment income or trust funds. I think you should keep your nose out of it. She could also be lying about how much she's getting back. |

Well, you do still have to file your income taxes if you're a citizen, even if you don't live in the USA. If she's claiming to be a US resident, that may be fraud.
The bottom line here is that you don't know enough about this person's exact situation to know for certain that something's going on. If she is doing wrong she will most likely get caught. My advice is to mind your own business on this one. |

Of everything mentioned, only the EIC is possibly in violation of the law. The EIC is only payable if the qualifying children live in the US unless her husband is active duty US military stationed overseas.
US citizens are subject to US tax laws on their world wide income. If she had no foreign income then there's nothing to file there.
If she filed married filing separately then she is entitled to the rebate for herself and any children listed on the return IF she has at least $3,000 in Qualifying Income. The rental income isn't qualifying income so if it's her only reported income she will receive $0 under the rebate. There is no requirement that the taxpayer live in the US or spend the rebate in the US and many expatriates will receive the rebate and spend it overseas where they live.
If she's doing anything illegal there's a fair likelihood that the IRS will eventually catch her out. However unless you have evidence of any illegal activity, other than hearsay, keep it to yourself. |

No, you don't get earned income credit for having rental income - that's not qualifying income for EIC although it does have to be declared on a tax return. Rental income isn't qualifying income for the stimulus program either.
It's possible that you didn't hear what you think you heard. It's also possible that she is just totally making up numbers and filing a totally false return, in which case the IRS is very likely to catch up with her - they probably wouldn't go after her in Spain for a few thousand dollars, but she'd be cut off from future activity like that. |

rent money could be considered income, also they may have needed to file his income while working in Spain.
The only people who care are the IRS and if she's wrong on her return, then she has to deal with it not YOU.
to receive the stimulus package they would need only to have made 3000 last year.
If you are worried about "free gov't money" I suggest you look at oil company subsidies, in years with record profits, they get 1.5 BILLION from the gov't.
or farmers who get CRP (money for not growing crops)
or drug companies who don't bother to offer a discount for their biggest customer...the receipents of medicare. |

No, it is not fraud and you should not worry about it. Tax laws are very complicated. Your sister may still be legally a resident of the US. You don't have all the facts. There is no requirement to spend the rebate in the US. when you get yours, you can use it to take a vacation in China if you want. |

The only illegal part of that is that she declared her husband and he works. But, I could very well be wrong about that depending on the type of work he does and whether or not he's a student. There's also a way for a spouse to declare the other spouse but I never knew the details to that
The stimulus package is a joke. If the $41,000 I paid in taxes is good enough to repay the loan the Fed took out to provide the stimulous package, then why isnt the $41,000 I paid in taxes good enough for me to receive the stimulous package?
There is nothing fair about US taxation. Get used to it, that's life. |
