okay my brothers friend hasnt worked in 2 years and he manages to brag about how he gets 3,000 for filing taxes.He showed us the taxcheck last year.He tells the tax preparer hes a selfemployed barber and they take it from there! How in the heck is he geting away with this?This isnt fair because i work hard! |

He lies to his tax preparer and he gets an Earned Income Credit that more than covers his self-employment taxes. This is actually a very old scam that the IRS is now beginning to uncover.
I had a woman once who said she was a babysitter who made $8,000 and had two kids and wanted all of her earnings to be legitimate. She owed over $1,000 in self-employment tax but qualified for a $4,000 Earned Income Credit that would have gotten her refund of around $3,000. However, I wouldn't do her taxes without receipts, because I knew it wasn't on the up and up. |

If he just claimed income he didn't have, then he'd have to PAY, not get money back. If he has children and claimed EIC for them based on this non-existent income, of course it's illegal - and he'll most likely get caught very soon, since the IRS is auditing more and more of EIC claims where income is not verified. When he gets caught he'll be paying back years of false refunds, plus interest and penalties, and could be prosecuted for it. And will also be banned from getting EIC even if he really did qualify for it for from 2 to 10 years - in his case, probably for 10. The IRS is very aware of the huge amount of fraud that goes on with EIC and is auditing more and more of the claims. |

he must have filed a 1099 self employed and had children to get the earned income credit the "taxes" he would owe on his so called income would come from the eic then what ever was left he would get |

If he tells the tax preparer he's a self-employed barber, the tax preparer will then tell him how much tax he OWES on the income he allegedly made cutting all those people's hair. He wouldn't get money back for lying about having an income, he'd have to pay money!
A *refund* is the amount of money you get back if you have PAID the IRS more money than you actually owe them. If he doesn't have any income, he doesn't pay in any taxes, so he's certainly not going to get any portion of them back.
Something about this guy's story sounds fishy. I think he's lying to you about what he actually tells his tax preparer. (Either that, or the tax preparer is lying to the IRS, which would be *extremely* illegal and could get him some time in jail. Most paid preparers aren't willing to risk that just to get some people a few extra bucks.) |

This doesn't sound legal, the tax preparer is using information provided by your brother's friend. Their is a good chance that this will eventually catch up with him or you could help by reporting him to IRS and if he is cheating you could be in line to receive reward. |

It does seem a little fishy. Unless he is claiming dependents I don't see how he is able to get back any kind of return if he isn't paying anything throughout the year. Does he have children that he supports (or children he is "claiming" he supports)? |

he's found a loop hole.. either that or he's working around something and claiming it...
or he's messing with you... BUT, if he's not working... making claims saying he is.. and there's a huge computer/index messup... sooner or later the feds will discover this mismatch and he'll have to be garnished for the taxes he owes.
all he has to do is have a tax I.D. reciepts, forms and proof he's working, home business.
which is easy actually....i wouldn't get TOO upset.. $3k isn't much to live off of...
if they're not making money... that $3k is junk... they've got to be living off of someone, somewhere?
probably making claim as a dependant.. that's another way to get funds from the government. i wonder whoever is footing their bills is aware that they may be an claimaint on their behalf?
there's so much more that needs to be explained, i'm not sure what else is going on... but out of work folks don't get much back, if even it's legit... $3k is chicken feed money.
but if they're illegit... sooner or later that will bounce back on them and they will have to owe those funds. |
