Is this tax fraud - revised?
I want to be considered as a co-owner with my bf's business. We have not filed any 1099's but will suffer penalties if we must. I want to claim that I paid myself a salary of 27k which is just enough to cover my mortgage and car note. I am doing this so that I can claim the interest paid on my mortgage (in my name only) as well as a few other deductions such as medical. I also want to receive the stimulus rebate for me and my daughter. Is this tax fraud? What are potential problems? I DO in fact work with my husband on the business. We both make business decisions. We just never really formally "paid" me for my work.

Sorry. We are engaged and have been engaged for a year. And dating for 6. So I just started calling him hubby. for tax purposes, he is my bf.

Why is everyone saying I didn't work? I DID work, I still DO work for the business. We are just trying to figure out the technicalities of the IRS. In fact, this business was started 3 years ago with a large chunk of my money as well. It just gets complicated because we never defined my position. I guess I am answering my own question. I know I worked for the business, so I guess I know it's not fraud. But how do I prove that to the IRS? All my work is for nothing because we never filed a 1099? We can't be the only business in the world that forgot to issue a 1099. What is it? Like a $50 fine?

No it's not fraud if you actually worked for the company. You don't NEED a 1099, you would just claim the income as self employment income. You will have to pay self employment taxes, about 15% but if you are willing to do that than I don't see a problem. I'm sure you have SOME sort of paper trail with the company if you ever HAD to prove that you participated in the business and your bf would want to claim that he paid you on his taxes as well.

Either you are formally employed, or you are not. Apparently, you were not formally employed. Your problem is in who pays social security taxes and such for the income you wish to claim. Since you were not formally employed, no employee taxes were withheld and turned over to social security. Which means, you are effectively self-employed, and as such are liable for social security tax on the income. Are you sure you want this kind of headache? If you claim to be employed, then you need documentation from your employer regarding taxes withheld. If no social security was withheld, i.e., self-employed working as a contractor for example, then you have to pay these taxes out of your pocket Either way, IRS will come looking for the social security taxes and such, from you if self-employed or from whoever you claim is your employer. You should have formalized the business relationship. Being in business, you should have known about the various employee taxes like social security that are withheld and turned over to social security when the business files its tax statements. Businesses with employees are ALL required to file tax returns specifically for the various taxes collected by the fed for social security and the state for unemployment, which is why when I ran a computer tech business, I never had any employees, just independent contractors, so it was up to the contractors to take care of social security and such as being self-employed. I did not want the headache from keeping track of the employee taxes. This is probably of little help to you. I just want you to be aware that you might be opening a can or worms. Time to consult with a tax professional.

Definitely fraud. One of the ways the IRS can find income is to examine your bank records. Usually this is to find income that was not reported, but I think it would be just as easy to not find income that is expected to be there.

Business income and expenses are reported on Schedule C and the net income goes on your return, Form 1040. If you report income that you have not earned then you are filing a false return. The IRS could put you in jail for filing a false return but more than likely if you are audited they will just assess the fradulent return penalties which are 75% of the tax you owe. Then you will have a tax debt that includes the tax you owe plus 75% penalty and interest on both to the date the return was due.

My point here is to get help preparing a true return.

Anyways, did you not read the esteemed bostonianmo's comment about how much your tax bill would be if you did this? This wouldn't even stand up to scrutiny. It would be found that you and your boyfriend live together and that he's paying you such a high salary for what was described in your previous question. You're even saying that the amount is enough to cover the mortgage and car note. Bad all around. You would be opening yourself up to a not-so-nice situation if you were to go through with this.

Um, yeah. That's *definitely* fraud.

(And you really should make up your mind whether he's your husband or your boyfriend. That makes a big difference for tax purposes too.)
