YES File "Married filing separately". This is why the IRS made this provision.
Make sure that the family assets are also separate. If his name is on the car title, give him the car. If the car note is paid by you insist that only your name is on the title. If there are any insurances on him and you are beneficiary, make sure that you pay the insurance bill (don't let them talk you into letting it laps or them paying).
All families financially should be divided, His - Hers - Theirs. This way it can clearly be stated where expenses will be paid from and what belongs to whom. A record kept of the check from what account is enough to determine ownership. |

You can file as married filing separately, including your own income and claiming your own exemption. If you file separately and one of you itemizes, the other can't take a standard deduction and must either use zero or itemize also.
It isn't illegal to file separately, it is definitely legal, and you don't have to have his agreement to do it. |

You can file a separate return but filing Married Filing Separately will cost you both quite a bit of money in most cases. If he has a heavy tax debt, filing a separate return might make sense for you as it will protect any refund you have coming from being taken by the IRS to satisfy his debt.
