You're only "screwed" to the extent that you can't get your refund until you file. There is no late filing penalty if you have a refund coming.
You should have filed a missing W-2 complaint with the IRS back on 2/15. The IRS would have leaned on your employer to get the W-2s out on time. In virtually all cases it only takes one call from the IRS threatening penalties of up to $150 per late W-2 to motivate most lazy employers. Alternatively the IRS would have assisted you in generating alternate docomentation of your income and withholdings so that you could have filed a timely return. |

Go ahead and file. If you don't owe anything, there won't be a penalty for filing late, and you'll still get your refund if you have one coming. |

You will be pleased to learn that there is NO penalty for failing to timely file your income tax return, as long as you owe nothing, or have a refund due to you. I'd hate to tell you how often I have not met the filing date, had a refund coming, and you simply get your refund. |

Tax law says you have to estimate your income if you didn't receive your W2 by filling out form 4852 and attaching it to your tax return. It's your responsibility to file your tax return, not your employer. Try to contact your employer or IRS

How delayed was your employer? By law they must mail your w-2 by January 29th of 2007. There are penalties for not filing taxes, so you may now owe something. |

Your employer is supposed to send out W2's within the month of January. If not, then hte employer is at fault. I also don't think that you waited five months on your W2's. A good accountant can gather enough information from check stubs. You better go see an accountant anyway. |

Don't panic. Do file. Contact the IRS. There will be some penalty, but it will come out of what they owed you.
ALWAYS file on time, and if you don't have all the correct data there is a process for an extension.
In the future, always contact them ahead of the deadline for advice. There is a form for every scenerio.
