Jobs seekers allowance?
Is this right?
Myself and my boyfriend recently moved to a new city, we rented a house and were both looking for jobs, i found a job with relative ease (after around a week) however my boyfriend took slightly longer so decided to claim job seekers to help with bills and rent, exactly what its there for.
He heard nothing for a month and has now been told he wont recieve any money at all because i earn over £90 a week?
Is that right? or is there anything we can do, he is now working so its not about the money, more the principle. Is this how it works, cos if he hadnt of got work I wouldnt have been able to pay our rent, bills and buy food with my wage!

their are 2 types of claims, it sounds like he has made a joint claim for the both of you (its worked out on both your incomes).

if he has paid enough NI he can claim a contribution based jsa, which is only based on his income, wether you are living together or not.

he needs to state its contribution based when he claims.

unfortunately theres nothing he can claim as you are working so are classed as the sole earner so therefore you have to support him
As long as you both a living together and you are working he cannot claim JSA

If you are living in concil or housing association accomodation, you may be able to get a little help with the rent and council tax
They wont pay all of it but they may pay some if you are on a low income

What you should have done is claim working tax credits and rent/council tax rebate as you live together as a couple. Afraid you were badly advised by the job centre. That is correct provided you are a couple, yes. Any income you have is treated as joint. If he wanted to claim he would have to claim as a single man and prove that you were just flatmates who did not constitute a single household (provided that was true and you weren't a cohabiting couple, of course). And believe me, that would be no mean feat to pull off after you've already claimed jointly in the past!

JSA income based is means tested....that means that any other money brought into the household like your wage is deducted off the benefit...which brought it to nil

JSA contribution based is paid whatever...as long as enough stamp has been paid by him in the last two full tax years

If you are renting you may still be able to claim housing benefit to help meet this cost ask your local authority

If you are over 25 and working 30 hours or more per week (16 hours if you have a child) You can both claim working tax credits. This will probably reduce any housing benefit to nil.....but it will be one or the other which will help you

If he was not working for the past 2 years he wont have paid NI contributions and would claim Income Support but if you are working you have to keep him but you can claim working tax credit and housing benefit and council tax benefit.

that seems completly wrong, did you get help with things like housing tax credit and council tax, you should have got help with them with the low income you brought in, id get intouch with the local council and ask them or fill in an app form for it. maybe they said no because you should have been getting help with housing etc, then they wont help you they are sods!! because they say that 90pound is ok if you havent gotta pay expenses.id appeal against it def.em

Jobseeker's Allowance (JSA) is paid if you are:
capable of working;
available for work;
actively seeking work;
18 or over;
not working 16 hours a week or more.
How to claim:

Contact your local Jobcentre. You will be given a JSA claim pack and an appointment to discuss your job seekers' agreement. This will indicate what steps you will take to find work. Your claim should be processed within 10 working days. You must 'sign on' at the job centre once a fortnight. You will have a short interview to check your situation, job seeking progress and any change of circumstances. You receive payment within a few days of signing on.



How much?

The amount varies by age and situation. If you're single and between 16 and 17, you will get £35.65 a week. If you're single and between 18 and 24, you will get £46.85 a week. If you have children you will be eligible for more - for example if you're 18 or over you will get £59.15 a week.



There are two types of Jobseeker's Allowance :



1. Income-based Jobseeker's Allowance

Income based JSA is 'means tested', this involves the Benefit Agency calculating how much you (and your family), need to live on according to their regulations. You can claim Income-based JSA if:


you have an insufficient contributions record;
your contributory JSA has run out after six months;
you are claiming for a partner.
When you claim income based JSA you claim separate allowances for yourself, any adult dependant and your children. You can also claim any premiums for which you or your dependants may qualify, such as Family Premium or Lone Parent Premium. If you have a mortgage on your home, you may also claim for mortgage interest payments.



2. Contributions-based JSA

This is based on your national insurance contribution record and is paid for a maximum period of 6 months.


If you are 18-24 years old you will find that the level of your benefit has been set at a reduced rate.
You can only claim contributory JSA for yourself.
Your right to claim contributory JSA is not affected by your partner's earnings or by the amount of savings you have.
You cannot get contribution-based JSA if you have only been paying NI contributions for self-employment. You may be able to get income-based JSA.
It is possible to get both at the same time. If you claim Contribution-based Jobseeker's Allowance you may be able to top up your income with Income-based Jobseeker's Allowance to a level that is worked out depending on your individual circumstances. Housing Benefit and Council Tax Benefit will be available for both.
