I just got married, and I dont feel like changing my name. Too much paperwork seriously, and I am already established. So is my husband. HE makes a lot of money though, and every year, he owes instead of breaking even or getting a return. I have a daughter, and I always get a return.
A friend of mine told me that she has not changed her name because She does not want to do anything joint together with him. They have separate investments and what not - but they share everything - just like us.
So I am just curious...if the only thing that shows youre legally married is the certificate, can you still live separate lives legally? When I thought about this, I realized that thousands of illegal immigrants marry for citizenship, and totally don't even talk to each other - or file taxes together for that matter. So what is the legal deal?

If you are married, you have to file as married, whether or not you changed your name. It is perfectly legal to keep your name and not change it, and you can file jointly with the different last names, or can file as married filing separately -there is no requirement to file a joint return.. But you are not allowed to file as single or as head of household. |

As others have noted, your name is really irrelevant, What matters is that you are married. One thing that folks haven't mentioned is the consequences if you live in a community property state. In those states, it's not entirely possible to live separate financial lives.
As for taxes, it's generally true that you have to file married jointly or separately, although there are situations where you can file head of household if you meet certain criteria. |

The information in Ash's post is incorrect. As far as the IRS is concerned marriage puts you in an entirely different tax category than an unmarried person. If you ARE married, it doesn't matter to them whether you change your name or not. You MUST file your return as 'Married filing Jointly' or 'Married Filing Separately', and if you choose the latter they require that you put your spouse's full name and social security number on your return. They do this on purpose to track double-dippers who try to cheat the system. If you do not follow the rules and file as single you may be penalized later when they find out---and they WILL find out eventually. Trust me, you don't want to mess with those people at the IRS. They will come after you! The IRS doesn't really care whether people who are working are here illegally or not, as long as they are paying taxes. The point is that Immigration can always deport illegals at any time, but because you are an American citizen, Uncle Sam, and more specifically, the IRS, will always know where to find you.
The people at the IRS aren't stupid. They know every trick and loophole in the book, and thats why they have very specific rules about everything. If you are a married person who files a tax return as a single person you had better make sure that you don't try to take credits, deductions, or exemptions for which your husband also applied, especially with jointly incurred expense deductions that are itemized, education credits, and the child tax credits. If you double-dip, even unintentionally, you run the risk of being audited. Not only would you also have to pay back all the money that you weren't entitled to but they will add stiff penalties to boot. |

If you are married, you will either have to file married filing jointly or married filing seperately. You must file with either one of those because there are certain limits that are only available for certain filing statuses. Do to the elimination of the married penalty, at least until 2010, there is no difference in filing between the two. I am sure that your husband would want to have you all claimed as dependents otherwise he will pay more tax. |

If you are living together as a married couple and not using either the "Married Filing Jointly" or the Married Filing Separately" then you are filing false tax returns. It is not legal. Most people do a lot better by filing jointly. Generally, you will pay more in taxes by filing single. You do not have to change your names. Poor excuse. You may want to relook at your taxes and amend them. Do not forget your state taxes either. You two are probably shortchanging yourself. Do not mess with Uncle Sam because later he will mess you. |

What you want to do is check box number 3 on line 6, Married Filing Separately.
You will have to put down your husband's name and SSN, but he will not have to sign it, and it will otherwise not include his tax information.
Remember though, since he has earned income you cannot take him as an exemption, and cannot claim the Married Filing Jointly deduction. Also, remember that only ONE of you can claim your daughter as a dependent and claim her exemption.
This will accomplish what you are asking for, but, you might actually get a refund if you actually do file jointly. You just have to do the math to find out. |

Just because you are married does not mean you have to file jointly. You can file which ever way you want. However it usually
makes sense to file jointly..more tax breaks |
