Maybe. If you lived with him all year, AND your total gross income for the year was under $3400 (not just under the amount to have to file), AND he provided over half of your total support for the year, he can probably claim you. If your relationship violates any state or local ordinance, he can't though whether the law is currently enforced or not - and believe it or not there are still many places with laws on the books with laws against cohabitation by unmarried couples.
As usual with this question - which gets asked multiple times a day - you have gotten more wrong answers than correct ones. |

Actually, according to the IRS website, it seems you may qualify, under the "qualifying relative" portion of dependency requirements:
"The person cannot be your qualifying child or the qualifying child of anyone else.
The person either (a) must be related to you in one of the ways listed under Relatives who do not have to live with you, or (b) must live with you all year as a member of your household (and your relationship must not violate local law).
The person's gross income for the year must be less than $3,300.
You must provide more than half of the person's total support for the year."

Sure you can, as long as you lived with him Jan 1st to Dec 31st, the whole calendar year. You would be his "qualified relative", because you lived in the same residence for the whole year, and he provided over half your living expenses. Even though you two are not related or married. He can claim you as a dependent. He couldn't claim "Head of Household" however. He would file as "Single", unless he has an actual related relative living with him and you. |

i don't think so because he only can file w2 as married or single but you can call tax consultant and ask them , they know more than us.

nope. sorry, why do you thing people are making such a big deal about gay marriages? It's so they can legally claim each other on taxes, but if the marriage is not legal, then neither is the claiming of the other person on their taxes. Sorry!
