The big gray area is "What constitutes a home?" If you live in a building with multiple tenants under "one roof" technically... each family could claim "head of household". If you live in a place that rented rooms, each could claim "head of household" (providing they met qualifying child, and other conditions). So what is the difference if two roommates share expenses 50/50? Couldn't it be argued that the tenants split the apartment/house into two "homes" each paying half of the total? It is the same as splitting a house into two or three living areas, and renting each to different people. The only difference is that:
1) They don't have an "apt A/B/C" appended to their address.
2) They don't have a security wall between residences.
How does the IRS decide? Do they look for 2 heads of housholds with same address? |

No. Head of household requires that you provide MORE THAN half the cost for the household, and it's impossible for each of you to provide MORE than half. In fact, if the split is exactly even, then neither of you can - but surely one or the other of you spent an extra dollar on household expenses. Only the person providing MORE than half can file as head of household. And that person must have a closely related person (a child certainly qualifies) living with them. |

Also, a taxpayer filing as head of household must furnish over half the cost of maintaining the household. Therefore, both parents may not file as head of household. For more information, please refer to Publication 501, Exemptions, Standard Deduction, and Filing Information, for more information.
You can claim Head of Household (with you and your son) and he can claim single with his son as a dependant. |

No, you can't. Only one person may claim head of household and from what you say your situation may not allow either. You need to both complete the worksheet that helps determine if you can file head of household. If you both qualify otherwise then you would have the one use that status that would most benefit from it. Read the linked information from the IRS and see if it helps. |
