it is whatever you where on december 31 2007, if you were considered legally married, you have to claim either married filing joint or separate, if you were considered divorced or single on 31 December you will claim either head of house hold or single. being engaged dosn't mean anything to the IRS |

But...
If, at the end of the tax year, they are still married to their previous partner, they file as married to that person.
Filing status is determined by marital status at the end of the tax year only, not by filing status when they file.
Even if they marry before they file, they still file based on their marital status at the end of the tax year.
There are only two exceptions:
Annulments, unlike divorces, are retroactive and do affect taxes for previous years.
If a person dies while married, and the surviving spouse does not remarry, the surviving spouse can file as married for the year of death, even though no longer married at the end of the year. |

Unless...... you are living together in a common law marriage that is recognized in the state where you now live or in the state where the common law marriage began.
In which case you are considered married for the whole year, and you and your "spouse" can file a joint return, or you can file separate returns. |

If you are not married, you can do Single.
You can also do MFJ if you're engaged, however beware, once you two have filed MFJ that's it. In the future should you not be together and you file separate the IRS may ask you during an examination for a complete divorce decree or a sep. agreement for audit purposes. Now if you have kids from a prior marriage or relationship and he claims them for the earned income credit or the child tax credit, he maybe reviewed for this and he'll have to produce the marriage certificate as you must be related to the child by marriage or blood in order to claim them on the return. So just some food for thought. |

yes and no. If you file married for one make sure the other person is in agreement. Two you just lost your right to a wedding because according to IRS you are claimed the day you file last names different or same as MARRIED in that State. So file single until after the wedding if you want a wedding to really mean commitment and family at it otherwise it's a cheap elopement. I have done taxes for over 14 years and worked closely with IRS and with lawyers on this issue. Oh, you can get the legal court signed marriage afterwords but it's not the same because it's cheaping the experience. |
