I just got married in nov and trying to decide if I should file mfs or single whichever will give me biggest refund. My husband still owes so I'm not gonna file with him this year. I made 19000 and my fed witholding is 1400. I claimed 1 myself all year. A lady at work told me that I should get back all 1400 but I've never gotten that much back though I hope she's right. Additional Details i guess this is why i am so confused. last yr i made about the same amount and i filed single and i got over $800 back. now i am being told i will only receive 250 if that...is that because i got married? if so thats ridiculous. |

Do you or your husband have any children that you are claiming. You cannot claim EIC, if you file seperatly.
Anyway, you can not file "single" if you are married. You can file seperatly if you want, or jointly. It really depends on your personal situation and such.
If it was me, I would file jointly. I did this when I married my husband. He had owed about 500 dollars in back child support whe we met. It was nice to get it paid and taken care of. Now we do not have to worry about it anymore.
You are got going to get that much back anyway. If you want to you can file an injured spouse form with your taxes. This basically tells the IRS, that the back amount is not your responsiblity (like if he owed back child support) This form can be a pain, though and if you may want a tax professional to assist you. |

I believe you both have to file as married, whether separately or together. Whatever your marital status as of Dec 31 is considered your filing status for that tax year. |

Ehh.. You'll get around 257 dollars.. Unless you have more deductions/credits that you are not telling us.
You have to file as married by the way! Either jointly or separately. If you were married on or before Dec 31st you must file as married for the whole year. Also it wont change anything filing single or married filing separately. The both offer the same standard deduction and the rest is the same unless your husband itemizes his deductions then you will have to itemize as well. |

If you were legally married on Dec. 31st you can only file Married Filing Separately or Married Filing Jointly. You should figure your taxes both way before deciding how you should file them. Most software and surely all tax professionals can do that comparison for you. |

I don't know where these people got there information, but you don't have to file married as long as your spouse agrees with you. You can file single, but that puts you in a higher tax bracket. If your not sure, contact an accountant or H&R Block for advise. |

I regret having to tell you that you can not file as single if you were married at year end. At least not legally. Your 2 options are married filing separately and jointly. Married filing separately has certain restrictions that you need to be aware of besides probably causing you and your spouce to pay higher taxes. If your spouce itemizes deductions, then you must also and vica versa.
Assuming you take the standard deduction and file separately, then your tax bill will be about $1650. Actually the same as filing as single, I believe.
I think you would be much better off filing jointly. You will need to talk to your spouce about how to split the money coming back. |

Once you got married, you no longer can file "single". Your choices are MFJ or MFS or in special circumstances head of household if you live separately. |

Since you are married you don't have the option to file as single anyway - your options are a joint return or married filing separately.
At your income level, you'd pay the same tax as single as you will as married filing separately.
The lady at work who said you should get back the whole $1400 doesn't know what she's talking about. |

Your choices are married filing separate or married filing joint, you do not have the choice of filing single (if you do you are committing the felony of tax fraud)
