My 17 year old daughter claimed exempt and is arguing that she doesnt owe tax - but she still has to pay right
My 17 year old daughter claimed exempt last year and earned more than she thought she would. She made $3900. She says that her boss told her that she should not have to pay still. My husband and I claim her on our taxes as a dependent so she cant claim herself. I have her owing the feds about $383 or so. She said her boss is saying its not true even with all the variables I have given. Can you shed some light on this for me?

Her boss probably doesn't know the whole story. Her boss probably doesn't realize that someone else is claiming her. Also, maybe he doesn't realize how much she earned.

I'm sure your numbers are accurate. She can't get out of paying taxes just because her boss, who probably isn't a tax expert, says she doesn't owe any taxes.

In a way, this is correct... She would be able to claim up to $5350 as a dedcution on her taxes for herself. She would be able to claim the personal exemption, but not the dependency exemption of $3400.. She is not required to file a tax return, but she should since she will receive the additional $300 tax rebate in May

However, in her case, here is what the tax code reads...

A dependent can claim up to wage + 300 (or $5350) whichever is less. So in this case, she would have $4200 as her personal exemption amount..


So, she would get no refund for any taxes, because none were paid, but she would get a $300 refund from the government in May...

The rules about exempt are that no taxes will be held out if no tax liability happened in previous year and none is expected in current year...Of course, it might be more beneficial to get her in the habit of having taxes taken out of her check...

In actuality, unless she has additional "unearned" income - i.e. investments, interest, etc, she would NOT OWE anything...

If your dependent had only wages of $3,900, she will not owe taxes. She cannot take her personal exemption of $3,400, however she has a standard deduction of $5,350 which reduces her taxable income to zero.

I am guessing that you are using $3,400 instead of the correct amount for standard deduction, which is $5,350.

If she correctly filled out her W-4 as exempt, she will not need to file a federal tax return as no income taxes were taken out.

Her employer is wrong. If a dependent earns more than $3400 they will not be exempt from paying taxes.

I think you may not be giving her the benefit of the standard deduction. Even though she cannot claim herself, she still gets the standard deduction for her filing status.
The standard deduction for Single is $5.350.
Since the deduction is more than her income, her taxable income/liability would be 0.

Dependents get a floating standard deduction. It's a minimum of $850, but it floats by the amount of the wages +$300. if she only made $3900 and had less than $300 in interest income, she's right, she doesn't owe.

The only way to get $383 for a tax bill is to forget to deduct any standard deduction at all.

She can file tax return as single dependent. She won't be able to claim her own exemption. She will still get standard deduction of $5,350 for earned income.

She will not owe any tax and is not required to file.
However, she must file to get refund of all the taxes withheld.

Here is the filing requirement for a dependent:
For Single dependents, you must file a return if any of the following apply.
• Your unearned income was more than $850.
• Your earned income was more than $5,350.
• Your gross income was more than the larger of:$850 (for 2008 $900), or Your earned income (up to $5,050) plus $300.
• Your self employed income is $400 or more.

She is not eligible for stimulus rebate on her return or on the parents return:
