A self-employed person's income tax return is the source document for crediting his social security account so even if he didn't owe any income tax he would have to file to get his benefits. Social Security benefits are skewed towards lower income workers--the benefits for the lower tier of earnings is 90% compared to 15% at the top--so he is shooting himself in the foot by not filing.

the only real trouble he is in is not having the money to pay the tax he owes.
but if he made very little, he may not owe too much.
just to put an end to the amount of years he has not filed, why do you file for this year. maybe go back and file for 2007, 2006, and 2005 too. it wont be too bad.
as for the other years, if he and the irs have no proof of how much he made, there really is not much that can be done. also, he my not have been required to file and at this point, if this is the case, then he is not even required to have the records.

Assume he is self-employed, then he is REQUIRED to file taxes if he earned more than $300 in a year, schedule C and 1040
He may or may not owe taxes, depends on deductions and expenses
And of course he should be paying estimated quarterly taxes
Suggest he get going on this, and file last 3 years immediately
Cash payments need to be reported just as much as check payments, and whether income is from legal or illegal source, it must be reported. . . . .Al Capone was jailed for tax evasion, not bootlegging or murder. . . |

According to IRS guidelines, all income is taxable whether it is from legal or illegal sources. In this case, more than likely, he will not be discovered. However, this type of lifestyle lends itself to several problems. As already mentioned, he is not paying into Social Security, which at 31, he probably doesn't even care about. The more important issue is that he can't document any income. This will severely limit his ability to secure any kind of credit such as a mortgage. Now if he never intends to own anything, he could probably go on like this forever. He should be reminded that we all hate to pay taxes but, unfortunately, our society is a tax based system. When people such as your son don't contribute to the system, those that do have to pay in need to ante up even more. Again, he probably doesn't care about this either. |

Aren't you glad that it's not your problem, but his? Payback time will come later in his career when he is thinking of retirement, but hasn't paid into a retirement plan, or social security. |

The odds are that he won't get caught, but if he does he could be in big trouble. A lot of people escape taxation by working in the 'underground economy.' |
