Ok, so the divorce isn't final yet, BUT he called me today to tell me that his return was delayed because he reported MY income on HIS return. Apparently he filed "married". I filed Head of Household because I paid all of our sons housing, education, medical expenses, insurance ect. I did not take any other deductions.
I filed prior to him and already got my refund back. Is this going to trigger an audit? Will the IRS freeze my bank account? He told me that he contacted the IRS, who pulled my return and input the correct information on his paperwork. Could that possibly be true??
Should I contact the IRS myself? And let them know what he's done??
I am soooo totally freaked out right now. Additional Details He moved out June 1st...and to date has paid nothing in support |

I would contact the IRS yourself and just explain the situation to them and see what they would recommend.
He shouldn't have the right to access any of your information anymore if you are legally separated from him, I'd be questioning why he was allowed this information in the first place if that is the case.
I'm sure if you're honest with them they can sort out any issues. |

Relax. If your son lives with you, you were OK filing as head of household as long as you didn't live together at any time after June 30. HE is the one with some explaining to do to the IRS. He wasn't allowed to file a joint return without your signature.
OK, he said the IRS corrected HIS paperwork. That won't affect yours. |

You should contact the IRS yourself. At this point, he isn't exactly trust-worthy. The divorce is happening for a reason...remember that. So what is your gut feeling on this? It's probably to call the IRS, and try to settle it before it becomes a negative mark on you! Since he filed first it seems, he will seem like the 'innocent' one, but if you take action right away, they will be on alert that something fishy is going on, and that it's not on your part.
So make the call, hun. It's the best thing you can do. One of the most dangerous things to do at a time like this is trust a member of the "Ex" committee. |

you are fine to file head of household. you can because you are supporting your kids and you have been living separate for more than 6 months last year. He must file Married Filing Separate. Or his return will be rejected. I take it that you are claiming your sons and they are 17 and younger so you can get the child tax credit.

More than likely, he electronically filed his return and it rejected, due to the fact of you had already filed. However, it is POSSIBLE that he mailed it in.
The rules for filing head of household (when you are not divorced, YET) is that you and he may not have lived together for the LAST 6 months of the year. And, that you provided MORE than 1/2 of the cost of keeping up a home for a qualifying person(s)....(Your kids) If this is in fact, true, then you have nothing to worry about. The IRS will not give your EX any information on your account. So don't fall for that. Contact IRS and explained to them that your soon to be EX told you IRS gave them info on your tax return. IRS should not have a reason to freeze your bank account if you don't owe IRS any money. IRS only freezes account when you owe and made no effort to pay them back.
Relax, call IRS early, by 7 a.m. or you could encounter a long wait time. |

If your divorce is not final by the end of the year, then legally you are still married. Per page 13 of the 1040 instructions, you could be considered unmarried, and therefore file as head of household if you meet certain conditions. 1) You lived apart from your spouse for the last 6 months of 2007. 2) You file a separate return from your spouse. 3) You paid over half the cost of keeping up your home for 2007. 4) Your home was the main home of your child. 5) You can claim this child as your dependent or could claim the child except that the child's other parent can claim him or her under the rule for Children of divorced or separated parents (pg 16 of instructions). |
