My Son was born 10/24/07 - Filing HOH - Qualify for EIC? Please Help!?
I have found conflicting information regarding this. It seems as though a "qualifying child" (I've read numerous times) has to have lived with you for more than half of the year (6 months, 1 day) otherwise they do not qualify for Earned Income Credit.

However, I downloaded a PDF for filing Head of Household, It is the EIC Schedule for 1040 -- On Line 6 it says:

Heading: "Number of months child lived with you in the United States during 2007"

If the child lived with you for more than half of 2007, but less than 7 months Enter "7"

If the child was born, or died in 2007 and your home was the child's home for the entire time he or she was alive during 2007, enter "12"

My son, even though born on 10/24 qualifies for that second option, correct? He was born in 2007, and my home was his only home for his entire life of 2007. (Just to be clear: He didn't die, he's alive.)

So, does this make him QUALIFIED for EIC? It seems as though it does.

Yes you are correct he does fit into the second option. Since he was born in 2007 you can claim him for the whole year as a dependent and qualifying child for EIC weather or not he is living or died.


PS You put 12 down. Just like then instructions tell you to.

A child who is born (or dies) during the year is considered to have lived with you ALL year for tax purposes. So enter 12 as the instructions tell you to.

This child qualifies as your dependent and for HoH filing status, the EIC, Child Tax Credit, Additional Child Tax Credit, etc.

your child would not qualify for eic, you would have had to provide at least 6 months of care to qualify for this credit, also you can verify this by using any free online tax service , they will walk you through this, all you have to do is input your info in, and they will let you know whether or not you can claim your son.

Yes, you are correct. You would enter "12" on line 6.

The point of this is to make sure that a child who has been alive for a full year spends at least half the year with you.

Congress and the IRS intend for you to count a child who was born in 2007 and has lived with you the whole time. That's the point of that "exception to the rule." So yes, you're correct...that child is a "qualifying child" for purposes of EITC.

Yes, the "half a year" rule doesn't count for the year the child is born as long as they lived with you the entire time they were alive, not counting the time in the hospital.

You still qualify for a newborn. The number of months rule applies to children who were around for the whole year.

If you have had a child BORN before 1-1-08 you qualify,

fill out your taxes and Add your child,

I have 3 , it asks for their date of birth and Social security number,

So answer honestly, 2 months
don't put a 7
put a 12


--those other questions are for people who are divorced or separated or not married,

Eg, My eldest child I claim him on my taxes because he lives with me,

If his father wanted to claim him, then he would have to ask me, since I have PHYSICAL custody,
