You've received quite a bit of bad advice here, and one that is on the right track.
You can claim him as a dependent if ALL of the following tests are met:
1. He is not the qualifying child of another taxpayer.
2. He lived with you for ALL of 2008.
3. He has less than $3,500 in gross income, excluding only non-taxable Social Security. (Not taxable income as ninasgramma says.)
4. You provided MORE than half of ALL of his support for the entire year.
5. Your relationship does not violate local law. Any law prohibiting co-habitation of unmarried persons, even if unenforced, bars the exemption claim.

A nonrelative may be your dependent if
1. He lived with you all year
2. He had income subject to tax less than $3,500
3. You paid for over half of his support
If your bf qualifies as your dependent, you can take an exemption of $3,500 for him. Your bf does not qualify you for Head of Household filing status or any credits. |

You can claim him if he lived with you ALL year, had gross income under $3500, you provided over half of his support, AND your relationship isn't illegal under state or local law - there are still a number of states, and some local areas, that have laws against cohabitation by unmarried adults - if the law is still on the books where you live, even if it isn't enforced any more, you can't claim him. |

No, not unless he is your dependent. WHich he is not as defined by the IRS. you can go to www.irs.gov and look up their definition of a dependent which is a legal definition. |
