justlooking | My boyfriend paid for all of my bills and expenses in 2007, can he claim me as a dependant? |
We've been living together for 9 years and last year was the first that he paid for everything...my student loans, bills, food, etc.
When I was younger and working, my father tried claiming me even though he didn't pay for anything, and the IRS agent said he had to pay more than 50% to be able to claim me.
I was just wondering if this was true for anyone who pays more than 50%-being able to claim someone as a dependant, or if it applies only to family. Additional Details I definitely made less than $2,000 in 2007. I quit my job to watch/deal with his kids who came to live with us and am doing freelance art when time permits.
We are living in Southern California. |

Perhaps, if you pass the tests for a qualifying relative. That means you must have lived together all year long, your gross income must be less than $3,400 and you must have provided more than half of her support. One other test: your living arrangements must not violate local law. Six states (Mississippi, Virginia, West Virginia, Florida, North Dakota and Michigan), for example, have rarely-enforced laws prohibiting cohabitation, and the IRS notes that some states prohibit couples from living together if one party is married to someone else. In such a case, the IRS says, a dependency exemption would be disallowed even if the other tests are met. |

he can if he paid more than 50%. It doesn't have to be family for it to count |

Maybe
It depends on what state you are in and if that state has laws against cohabitation. |

I think he can. Aww you are so lucky to have a man pay for your bills, as long as he treats you with respect, he is a keeper |

No, there is no law that if you pay over 50% of supporting someone you can claim them. Even with family, there are additional requirements you must meet.
If you live someplace where there is a law still on the books against cohabitation between unmarried couples - and believe it or not, there are still several states and many more local areas with laws like this - even if they aren't enforced they still count - then he can't claim you. If you had gross income over $3400 for the year, he can't claim you. Otherwise he very possibly can from the info you give. |

Being able to claim a dependent on a tax return is tied to a number of related tax benefits. Taxpayers who claim dependents can claim an additional personal exemption for each dependent. Also, taxpayers may be eligible to claim the child tax credit, the child and dependent care tax credit, and the earned income tax credit. Unmarried taxpayers who support a dependent may be eligible to file as head of household.
With all these tax benefits tied to claiming a dependent, it is important to make sure that you really can claim the dependent on your tax return.
Basically, you can claim a dependent if the person meets one of two criteria:
* qualifying child or
* qualifying relative. |

It seems to me he can claim you as spouse, depending on how much you made. If you made a lot of money, claiming you in any way will be moot. |

No. He would need to be your legal guardian or spouse. Even if you live in a common-law state, this is a tricky matter and you'd be hard pressed to find a CPA willing to file his taxes for him claiming you as a dependant. |
