If he qualifiy's to get a rebate check via bush's guidelines (made at least $3,000 last year, etc.), then yes, he will get one, what matters is if he gets to keep it.
If he is $500 or more behind in chld support then the IRS will send his tax refund and this new tax rebate onto the child support agency, to pay towards his back child support. If he is not at least $500 behind, then they will not send his refund or rebate to child support. If he is more than $500 behind but his tax return and rebate are more than what he owes in back support, he will get the difference returned to him. |

The check should go to the person who is claiming that child on their tax return. Meaning that child is residing with you at least 6+ months out of the year. Him paying child support doesn't entitle him to the refund. |

EDIT: I think the poster is asking about the Bush tax incentive, which has nothing to do with how many kids one has or who claims the children on the taxes. The Bush tax incentive is completely separate. |

The person who claims the child or children on their 2007 tax return is the one who will get the rebate if any is due. Normally the parent paying support does not claim the exemptions for the children, the parent with physical custody does. If that's the case in your situation then YOU will get any rebate if any is due to you. |

I think it depends on which parent claims the child(ren) on the tax form. Whichever parent claims the deduction would get the additional money, as children can't be exempted by both parents. |
