Yes, he can file using either the short form or the IRS long form 1040. If he does file his taxes based upon cash earnings, he will most likely end up having to pay ALOT of money before April 15th, unless he has made estimated tax payments during the previous year on his own, using the IRS form for that. |

If he is a resident alien he follows the same tax rules as U.S. citizens. He has self employed income and he would file a 1040 with a Schedule C to determine his net income after expenses. |

If he is a legal resident and being paid cash, he most likely won't recieve the forms from his employer(employers are noramlly the ones who sedn employees the needed forms.) Actually, paying under the table(paying cash) is illegal and you brother in law should go to the proper agency and report it, because there is most likely no paper trail and no way to tax the employer or your brother in law. He should go to the buetter business bureau, or commerce office to report the employer. Besides most employers who pay under the table normally aren't paying minimum wage...or if they are, it's probably federal minimum wage, which in some cases can been illegal if he's not recieving tips, meals or housing from the company. My first job I was payed federal minimum wage, but I was also recieving tips. |

What kind of resident? Yes he can and should file a tax return. It's the normal forms, 1040, plus Schedule C probably. There's been no withholding, so self employment taxes apply. |

He needs a 1099 from his employer. He would be considered self-employeed. It doesn't matter how he is paid he's responsible for coming up with the 30% needed for federal, state and local taxes, etc.... |

If he is getting paid under the table, meaning if his employer is not filing that he is paying your brother n law, then no he cannot file taxes as he is not paying any. He needs to talk to his employer and see if he is getting taxes taken out of his pay and if he is he needs to get proof from his employer of the amount being taken out and how much was taken out for the whole year and how much his total earned income was for that year. Then talk to a tax consultant. |

Depends on what he does for a living. See a tax accountant.
Note that he'll probably pay a penalty for not making quarterly tax payments. You can't wait to the end of the year to pay your taxes. |

He can only file if he has any witholding taxes taken out of his pay. His employer needs to send him a W2. That tells what he made and how much was witheld. |
