He does. It is his money that was withheld, not yours. A tax refund is not a gift from the government. HIS income was withheld to pay taxes. When he gets a refund, the government is paying him back the amount of HIS income that was withheld that exceeded his taxes.

Cara is right, a person can only claim someone as depend ants who live with them more than 6 months out of the year, but some courts do set up divorce papers that say a non-custodial parent can claim a child every other year or one parent gets odd years and the other even years. The non-custodial parent has to submit a copy of divorce decree with his/her 1040 form to show the IRS that he/she is eligible to claim child.
As far as the question is concerned - The dad will get the extra $300 this year, sorry mom. maybe you and him can work something out.
I also don't see how you get that child on your earned income when he is claiming the child as an depend ant.

I think if you claim 1 child and he claims 1 child as a dependant you both will get a refund

Whoever claimed the child as a dependent for 2007 gets the extra $300 stimulus money for them.
