He did get one paycheck after he died, but it was sent to his ex girlfriend's house and she is no good because she never even gave it to me. Why do you have to file his taxes? They arent going to audit him. If his ex girlfriend kept and cashed his check then it is forgery and theft. You dont have to file his taxes as far as I know. Check with a local tax professional please. |

Sorry for your loss. I would suggest you go to the IRS website and file an extension. That will give you until October to pull the finances together.

If there is an estate involved, and you are executor, the costs of a tax accountant and attorney would be paid by the estate, and their services might save you a lot of hassle. |

I think if you can get his death certificate for free. Go to your local city hall and get that.
You may also want to contact your local state county attorneys office. They are there to serve the public. I believe its free for advice. |

Check his 2007 tax return. If you can not locate it, then you can contact IRS for transcripts of the return.
Regularly check the mail, you may get W2s and 1099s. Do not rush, take your time to collect all the info.
Keep track of who gets what after your dad's death. They are all responsible for paying your dad's dues if any.

First it mostly depends on if you inherited anything. If you inherited the estate then you will be responsible for filing the income taxes, if you are the main heir to his estate then you need to find out where he was working, you can call them and get a copy of his W2. There has got to be someone, friend, family member,neighbor or someone who knew where he was working. What you inherit will be taxed and you will be responsible for all debt, including income tax, if you don't file they can then bill you for what he owes. |

If you really don't know any or all of the places he worked in 2008, you should probably just wait until about July. Sometime around July 1, the IRS will have compiled all the documents that they will be receiving for each of us from our employers, banks, etc. They can at that time issue you a transcript of everything that showed up against your father's SSN. You will probably need a death certificate to get that transcript. They will even help you fill out his last tax return.

you need to call/visit the probate court office in the city/town he resided in before you do anything else:
probate is a process for determining heirs, paying creditors, and distributing assets. any contractual asset (bound by contract) payable to the estate of the owner must go through probate court. it also only applies to individual or jointly-owned property.
if an individual dies without a Will, a personal representative will file a petition with the court. then the court appoints an administrator - usually the nearest relative (as in you). notice of probate proceedings are published in the local newspaper to alert anyone with claims against the estate to file them, usually within five months.
since your Dad had no Will, petition the court to become the personal representative. if validated, you will be responsible for carrying out all of the duties of an executor.....at *that* point, you will most likely want to consult with an attorney...if you don't have the money to do so, then, you'll need to handle it all on your own (not recommended)....
btw, as the executor, you'll have the rights to all info necessary for settling his estate by contacting the correct sources and providing them with proof of your status as executor, as well as his death certificate (for instance, for tax-related matters, you'd need to contact the social security department). |
