My daughter is 10 years. She receives SS survivors benefits . Can I still claim her as a dependant?
I earn approximately $29000 per year, and my daughter has no source of income other than the death benefits which are approximatelt $700 per month. Does she or I have to claim this as income? And can I still claim her as a dependent? I was told several years ago (from the IRS tax helpline) that neither of us would need to file or claim this income. But a friend of mine in a similar situation was recently audited and told that she could not claim her son as a dependent because he receives disability benefits, and will have to pay back her tax refund. Is the difference between death and disability benefits? I'm very confused since we both received our information directly from the IRS.

VB's answer is the correct one. You can claim her as a dependent and she does not have to file a tax return.

All answers which say that you can claim her if you provide 50% of her support are incorrect. The actual requirement is that (along with the information you provided in your message) she not provide at least half of her own support. Although those statements sound similar, there is considerable difference between them.

As far as whether she has to file, children's social security benefits are taxed the same as retired individual's benefits. For a single person, if 1/2 of her social security plus her other income is over $25K part of her benefits my be taxable.

Since her total income is under $25K, it is impossible for her to owe tax on the social security. She has no other income, so she does not need to file.

1. As income, the benefits are hers (her SSN will be on the 1099). If she has no other income, this isn't taxable to her.

2. In terms of claiming her as a dependent, this usually boils down to support. Either your daughter supported herself or she didn't. In order for her *not* to have supported herself, you would have to show that her expenses for the year were at least double the benefits she received from Social Security. (Before 2005, you also had to prove that *you* provided more than half of the support which was even harder.)

There is a support test worksheet in IRS publication 501. Use it. To your benefit, while your income went to pay for rent, utilities and food, a share of that will actually be counted as part of your child's support.

Apparently your friend never filled out the worksheet and when the IRS did it, they determined that the child supported themselves.

Check again at www.irs.gov. There should be an IRS publication that covers your issue. Then you will have the answer from them in print.

If she gets more than half of her support from you you can claim her.

The SS death benefit is different than disability benefits, is it not? You also provide more than 50% of her support, so you should still be able to claim her.

As a 10 year old I don't believe she can claim taxes yet. Who gets the $700. If you get it....im not sure. If she gets it im sure you can still claim her asuming she lives with you.

a 10 year old can not file her own taxes.......there fore not only is she your dependant but, her income is yours as well to claim and pay taxes on
