I have left uk a month ago.When I left my employer told me he will send my p45 to me,but he didnt ,when i called him to ask for he told he sent me and he has got a copy of it but he will not send it again.I am sure he didnt send it to me,and also my last two payslips.
I have p85 form to get tax back,but it says i have to send a p45 wth it also.I should get back tax because i have paid a lot ,but will i get it back if i dont have p45?Can i do anything about it,or i have no chance to get tax refund? |

You have form P85. Contact tax office, employer may have sent all copies of P45 there. Even if not, if they have only got tax copy, they may have enough information to review your claim.
If employer has sent your copy to you, and it has got lost, he is not allowed to issue another, but he can give you a signed letter on headed notepaper with leaving details of pay and tax on it. Tax office also has form P43 that can be sent asking for details from him if he hasn't notified them.
If all else fails, he has to send form showing pay and tax for 2007/2008 tax year with his employer's return. He has about six weeks in which to do this from 5th April. The information can take a long time to get processed by HMRC. Normally when someone leaves mid year, form P60 is scrapped, but you could ask if he will send that to you.
Suggest you send written authorisation for someone you trust to act on your behalf in this country, as it can be difficult to make contact from abroad.
You will get your refund, but it may take longer to get it without P45. Could be months rather than weeks. |

Yes you will eventually get any overpaid tax back to you. Usually every April your balance will be checked and any outstanding amount will be refunded back to you.
However to quicken up the process you can contact the Inland revenue by phone (should be on the back of your payslip) and they should be able to sort things out within a month or so. |

Contact them again saying your next course of action is to take it up with HMRC who have a contact number for this.
They are breaking the law witholding your money and P45 and you can take action against them
Another way to do it which my cousin did was to get citizens advice to write your former employer a letter. They are better at the legal wording and she got her pay an P45 pretty quick after that |

I agree with Ed. I have been in EXACTLY the same situation as you and am still trying to resolve it all, almost a year on. HMRC are so fast to take tax but so stubborn when it comes to giving it back. |

Simply ask your employer for a Statement of Earnings in it's place. If he will not give this to you, don't worry. Send the P85 with a covering letter explaining you do not have the P45. The tax office will usually have your pay & tax details directly from the employer. If not, they can request it directly from the employer concerned, but this will obviously be more time consuming. |

You are correct the original P45 parts 2 & 3 are requested to be attached to the P85 (Leaving the UK form).
Quite simply if you have not received your P45, for whatever reason, provide a covering letter to the P85 stating that you have not received these parts and therefore cannot supply them.
You will not be penalised for this and this will not mean you cannot claim back your tax for the 2007-2008 tax year. However it may delay matters if the HMRC have not themselves received the P45 details are they will have to contact the employer directly for them.
Therefore send the P85 in with this covering letter and ensure you have sent in a P86 (Arrival in the UK form) previously.
