I have to use a full 8 hours, even if I've worked enough during the week to only use an hour or two. For example, if I worked 9 hours day 1, 10 hours day 2, 9 hours day 3, and 9 hours day 4, and called out sick day 5, I would still have to use 8 sick hours even though it would appear I only need to use 3 hours. Does this sound right? I live in NY and have a salaried position. Can anyone tell me where this can be found in Dept of Labor regulations? Here's the direct quote from the New York Department of labor:
"Under the New York State Labor Law, payment for holidays, sick time or vacation -- i.e. payment for time not actually worked - is not required unless the employer has established a policy to grant such pay. When an employer does decide to create a benefit policy, that employer is free to impose any conditions they choose."
This means they can require you to take 8 hours of sick pay if you miss a day of work. They "imposed those conditions".

He can make what rules he wants to for sick time - he isn't required to give it to you at all.
In your example though, he would have to pay you for the 37 hours you did work that week. He doesn't have to pay you overtime pay though, since you didn't actually WORK over 40 hours for the week, even if you get paid for the 8 hrs sick time so your paid hours for the week are 45. |

My job is the same way, i have had it explained to me as "its the only way the payroll system will allow it" however i do have the option to take a 1/2 day, but we are not able to use 1 or 2 hours. Honestly I think if you go through the process of contacting the dept of labor you will just be wasting time. call your HR person and ask them if you take a whole day of sick time or a half day if possible if it will turn the other hours into overtime??? |

What they are doing is legal because you were still out sick for 8 hours, despite the fact that you worked extra hours during the week. Some bosses are nice and will let that kind of thing slide (apparently not yours though). Sorry. The best thing to do is stop working extra hours for nothing!!! |

If you're salaried, then I'm not clear why this would make any difference.
It does sound kind of fishy however. And if treating it as 8 Hrs. means you lose a days pay, then my guess is that wouldn't fly with state rules.
Rather than trying to read regulations, a better way might be to just call the NY Labor people and ask the question. Regulations tend to read like a Chinese dictionary. |

I have no idea. I have over 400 hours of accumulated sick leave, and we can use whatever we want, as many or as little as we want. Here you earn approximately one day of sick leave each month. |

That's the point of salaried position. You're NOT paid hourly, and if you're gone, you're gone for the day, not an hour or two. And that's why you don't get paid overtime, either. |

If that's your employer's rule then that's what you have to do. There is no statutory entitlement to sick pay so employers are free to write their own rules and policies on it. |

here in cali i can take a half sick day and only use half of the hours not a full day. that doesnt sound correct to me at all =. you should try to call your human reasources department to find out what the exact ruling is. if your employer is wrong the report him to the HR Office. |

Sick leave is an entitlement , not a right,to be used when you are too ill to come to work.
Salaried positions means that you have no accounting for hours and are required to do the number of hours necessary to do the job.
You cannot accrue time unless you have a flextime arrangement and can take RDOs in luie of working a weekend etc.
If you have to work a 10 hour day that is bad luck that is what salary means ...no paid overtime , no time in leui
Your boss is right if you are sick dont come in, take the day, if you are not sick you are expected at work. |
