I live in South Dakota, and have three children. Their father and I never did get married, but he signed affidavits in the hospital. He has since moved out last May, and I filed for child support from June 01, 2007 on. Just in Dec I started to get the child support. Now, I went and filed my Income Taxes, and it came back rejected! He claimed the kids on his! I had them all 12 months out of the year, and him not even a full 5. Plus he is behind on child support! He has called me and said it doesn't matter because I get it anyway, but it does matter! Not only does he owe his back child support, that EIC belongs to me PLUS the back support. And he will also get the tax break checks in June when I have the children! It's not fair, please help!!! |

I would talk to the Friend of the Court, or a lawyer. If he's behind on child support, and you can prove it then he's in the wrong. Good luck to you. |

Because your ex filed first, you cannot file electronically.
But you should still file a paper return and include your kids as dependents. When the IRS gets two returns claiming the same dependents they will issue both taxpayers letters and demand proof that the kids were your dependents.
If, as it sounds, you can prove the kids are your dependents the IRS will issue you your refund, and will go after your ex for repayment of his refund, plus interest and penalties.
It is going to take a while for you to get your refund, but it will happen. |

read up on the papers that were sent to you - there should be something about if you don't agree with the IRS's decision, you need to do that - because YOU are supposed to get the children - unless y ou have some sort of written proof otherwise.
just for a note for you: you can still claim the EIC on your children - even though he used them as a dependant. but, I would DEFINATELY call the IRS or read up on those papers - and Do what needs to be done...because, you are right, and thinking ahead about the tax break checks - |

Mail in your return, claiming the children - you have the legal right to claim them, he doesn't. He and you will each receive a letter from the IRS telling you that two people claimed the same person, and saying that whoever didn't have the right to the claim needs to file an amended return dropping the claim - then if nobody does, they'll investigate and decide who gets the exemption. The other person will have to pay back whatever he got by making the claim he wasn't entitles to, with interest and possible penalties. |

You need to show proof that the kids lived with you at your address during the year. Like if you have receipts for some of the stuff that you bought them, where the school papers get mailed too, etc. I work with a lady who takes care of her grandson and her grandsons mother filed for custody of him and she proved that she takes care of him so she won and the mother of the boy has to pay back all that money that she got back. Good luck i hope it all goes right for you. |

From what I have read, you are going to have to send the IRS proof that you are the custodial parent. That will entitle YOU to receive the tax benefits of your dependents. Depending on who reviews the information you send them, the father could end up having to pay back the refund. The only way to prevent this in the future is to file early so HIS return will be the one that bounces, not yours. Good luck.

You need to talk to a tax attorney fast. I pay child support and know he had no right to the eic. Granted the father seems to have no rights but what he did was wrong. You get him girl! Good luck. |

Your letter from the IRS rejecting your return should have info about disputing this.
Dispute it! He is in the wrong and you are legally entitled to the claim the children.
Call or write the IRS using the info they gave you, they will investigage it and eventually you will get your money.
Sorry your ex is such a jerk, easy to see why he is an Ex. |

If he provides the child support the children are his dependents. That assumes that the amount of child support is over 50 percent of their total support. It does not matter where the children live if certain conditions are met. His being behind with payments is a different issue. The IRS may withhold his refund if they know he is in default. But they won't know he is in default if you don't make a claim for the defaulted payments. |
