My ex-employer will NOT issue me a 1099. How do I report the income?
It is a rather sordid tale. I received payment for work I did in tax years 2006 and 2007. It was completely under the table with very few records. I resigned when I discovered illegal activities (mail fraud, wire fraud and counterfeiting) going on.

I am losing sleep over not paying income tax for those 2 years. The employer will not send a 1099. In fact, he threatened my life over this whole mess. I am literally afraid to contact him.

I can estimate what I received fairly accurately. Where do I put it on the 1040? Will a flag be raised if there is no 1099 included with the 1040?

Please help me sleep tonight. I am trying to do the right thing. (Which, yes, means I have already made contact with the appropriate agencies to look into the illegal activities and do whatever they will.)

You have two alternatives.
One is to forget filing. The employer has not reported your wages. Illegal!

You can file without a 1099, pay the tax, Medicare, self employment tax.
The door will open to the employer being investigated.
Big time sh** for him.

If you have reported him, your identity should remain anonymous.
If you file, your identity may come to light.

Under the circumstances, You should speak to a tax attorney.
It sounds like you may need protection. No one here has the knowledge or the expertise to do that.

Without a 1099, the employer may be responsible for all your taxes, even tho he did not withold from you.

You show the income and any associated allowable expenses on a schedule C or C-EZ. You wouldn't send in a copy anyway of your 1099-misc if you had one, so this won't raise any red flags. This will get YOU back legal even if the other guy isn't.

You are required by law to report your income even if you do not receive a 1099. So report the income that you know that your received for your 2006 return and for your 2007 return. Deduct any expenses that you incurred while working there. You will have to pay federal income taxes and 15% social security and medicare taxes on your net income. File a Schedule C and SE and attach it to your 1040. I don't understand why this guy would'nt want to issue you a 1099 because he can use that as a deduction on his tax return. But that's his problem, not yours. Do the right thing.

Go to H&R Block and ask them but I think you would just list it under self employment ( just as if you were a subcontractor).

On Schedule C, I would write: "Taxpayer received 1099 income for tax years 2006 and 2007. Employer refuses to issue taxpayer his/her 1099 and taxpayer suspects fraud.. Taxpayer has no way of knowing amount Employer reported."

If you have notes or any type of communication from your employer or pay stubs, i would send copies along with your 1040. That way you have reported but did not send fraudulent information to IRS.

If it was under the table, the government doesn't know about it. There is no paperwork, there are no taxes.
