My ex husband forged my name on tax documents, any idea what will happen to him? Jail?
We were already divorced, I have full custody of son, whom he DOES NOT support in any way. He went to HR Block, filed a joint return claiming ME as dependant as well as my son. Forged my signature on return. Got a refund anticipation loan check which he immediately cashed. This was last year and as I filed a seperate return as single claiming my son, it raised a red flag. My tax refund was held untill I sent documentation proving we were divorced and I supported my son. I am just wondering now that he was found in the wrong by IRS what may happen to him. I am hoping jail time. Any ideas?

I sent them my decree, cudtody order, support order and protection order, all were dated 1 year before return was signed.
I have been cleared. They now fully see we were divorced, living several states apart, plus I freaking make 30 grand a year MORE THAN HIM!! He is an idiot

that's his problem.

IRS has the option of referring his case to the US Attorney for the district in which he lives. if he disappears or is unwilling to cough up the back taxes, plus interest and penalties they may well do that.

H+R Block's bank [HSBC] is also chasing him since he defrauded them out of the tax anticipation loan. They may well refer the case to the local DA for prosecution on fraud charges.

meanwhile, you should be asking the court in your state to declare him in violation of the court ordered child support that he isn't paying. And then ask for an order attaching his banking accounts and wages.

You'll have to send those to the state he is now living in [your attorney will know how to do this]. Your goal with all this is to seize any and everything you can to fulfill the child support order. [besides, funds and assets seized for child support can't be wasted by him on lawyers to fight his criminal cases.]

They won't just arrest him a slap him in jail. What he has done is illegal and they will catch him. They will make him correct his return, and they will fine him and charge him interest and penalty on the amount he owed. He will only go to jail if he won't pay them. This will cost him. The IRS is a pain in the a** to get in trouble with.

only if he refuses to pay, or evades authorities, or is jobless. typically speaking even if you avoid the IRS or refuse to pay, or can't pay at the moment on your own, the IRS will simply garnish your wages. but in this instances of fraud, he could very well get jail time. you could even press charges on him, as he was practically stealing with you. talk to a lawyer or tax accountant to be sure. but i am pretty sure you can put him in jail if you are half of a mind.

you should have an IRS office near you. go there, and see what are your options . and your ex problems are not with the IRS now its with the bank that made the loan, they can get real nasty.

take the proof to your District attorney. Also file injured spouse with the IRS so that actions taken against him will not effect your future earnings.

I don't think he will go to jail. He will have to pay the corrected amount (the difference between what he did pay in taxes, and what he should have paid). Which will mean paying back the refund and then some probably. On top of that he will have to pay interest and penalties.
While what he did was stupid I don't think it will be worth it to the IRS to have him prosecuted.
I'm glad you were cleared. Sounds like it was pretty cut and dry since you had all of the documentation.
