How soon you will receive any portion due you for child support is a tough question. If your ex-husband filed a joint return and his wife filed "injured spouse" it generally takes longer to process the return. Him filing separate might speed up the processing of his return but how that reflects in how fast you would see any money is hard to say. |

His being married should not affect your receiving child support. If he's married they can file an injured spouse form to keep her money from going to your child support. Contact the appropriate agency to get a better answer. |

As long as back supports are on records with the IRS, your ex's return will be watch, but since he does not file tax returns, if you are concern about the tax rebate, only people who file tax returns will get any tax rebate. |

File separate, head of household. Since you have the children, that qualifies you. Take him back into court, if he's not paying they can put him in jail. They can also garnish his return for the back child support. Check with Legal Aid for all the details. |

Yes they will still hold the payment from his taxes, if he owes enough in back support to qualify. You MIGHT get it a little quicker than the normal 3 month manditory waiting period, but that is only at the IRS's discretion, & they determine that on a case by case basis. If he would have filed jointly, then they wouldn't deviate from the normal 3 month waiting period under any curcumstance. |
