My ex owes back child support and students loans, so who gets his tax refund and stimulus package?
He owes 7,000 in back child support and I think his loand have been defaulted since late 2006 or early 2007. And I don't recieve any state assistance:)

OK, Everyone I finally got through to the IRS and they said only if i got welfare cash asst. which is tanif in my state that I would get his refund. But since I didn't collect that welfare his refund goes to pay for his federal students loans before theyll pay for back child support even if the state requested it:( So he mooched off of a community college for 2 years to have a free place to live and didn't pay back for his loans and that just made it worse for me and my son. That's bullshit and the federal government shouldn't lend out money to dead beats:)

Since it is his tax refund... he gets it. If you have a problem with him not paying child support, that's for the courts to decide. You can't just immediately think you get his tax refund. The law doesn't work like that.

If you are already garnishing his wages your children get the taxes. You will only get it if the government is already involved with helping you get support for your child. Children are in line ahead of any loans.

You are correct. Unless you're on welfare (TANF) the student loans take priority over child support. I know that that sounds effed up, but it's the way that it works unfortunately. If I were in your shoes, I'd be gunning to garnish his wages; you'll probably have better luck there.

From experience I can tell you that what he owes the state will be kept back first. I am not sure about whether they with hold taxes for child support or not, my sister's ex is so backed up with payments yet he gets his refunds... I know someone who owed student loans and every refund that was due him, went to the loan, he'd get a letter saying your refund is this amount, however, we've applied it to...

It depends on what state you live in. Call your local domestic relations (which is located at your county seat courthouse). They can give you more information.

I hope you get it, that would be fare. The court system isn't always fare though. Good luck.

Okay...if he owes back child support and it is court ordered than you will get the tax refund and stimulus package....He can have a defaulted loan and not be tax certified....when a person defaults they are usually tax ceritifed November of that year...however child support comes before anything...such as defaulted loans or wage garnishment....they give the most percentage to child support

The first thing to do is take it to court and get it on the public record.

If this has been done. Go back and "remind" the State that he is in that he owes back child support and you have found out that he is due tax refund money. Technically, it already belongs to you. As such, it may very well be already earmarked for you, but no harm in making sure and letting the State know with a heads up.

Stay on it! The child support isn't for you, but for your kids. So knowing, stay adament.

Call your child support office...I call mine at least once a month to try to get some indication that he's working or gaining income some way. Techincally they should be turning over his refund/rebate checks to you, but make a nuisance of yourself so they remember you're still there. It can sometimes be held for months before they'll disperse it, so don't count on it for a summer vacation.

Grant, you're wrong. My ex owed back support, and I did indeed get his full refund, and I wasn't getting any govt. assistance.
