This has happened to me. if yo ufile through a tax return company they will help....if he files before you he will get the return of course....you still need to file as normal WITH the child on your return....your return will be flagged saying child already claimed basically...you will then show the documents to the tax rep showing you have a court order to file the child. The tax rep will notify the IRS...the IRS will take the money back automatically within i believe 14 days and then you will get the refund..... Go through a good tax return company HRBlock is good....they will definitly help you with this. You dont need a attorney

Just file your return and claim him. If he beats you to the punch and files first, you'll have to file a paper return by mail. The IRS will automatically get involved in the dispute at that point and will award the exemption according to the law.

So who cares if he files taxes fraudulently. You have the court papers to justify you claim. The IRS will cross check you and your husbands taxes and notice 2 filers claim the same deduction. To prevent them from coming back to you, include a copy of the court order and a letter explaining what you did and why you did it. Let them go after your husband. He will end up paying interest and penalties for his improper filings. It usually takes a couple of years for the IRS to catch up so you should do this for at least 3 years or until you know he stopped claiming him as a deduction.

This has happened to me but I didn't know my ex was claiming the children. They didn't live with him and he didn't even provide any support for them. They finally caught it, claimed that I owed all the money they sent me and then I had to provide proof to the IRS....good thing you have a court order!

Anyway, if the IRS receives his tax return first, you will not be able to file electronically (because they already have your son's SS# for 2008) and will need to file a paper return. You can contact the IRS and let them know as well. Document who you talk to. They won't discuss anything about his return, but at least it will be noted and they may take action sooner rather than later when they do their audits and see that two people claimed the same dependent.

If your son lives with you, then just claim him yourself. If he lives with your ex, then it depends on whether your court order has all the proper legal wording - if it doesn't, the IRS won't accept it.

Don't worry about what your ex might do -- just go ahead and claim him. When the IRS sees two returns that each claim the same child, they'll investigate. They'll send each of you a letter asking you to prove your right to claim the child. At that point, you show them a copy of the court order, they'll give the deduction to you, and they'll make your ex pay back any credit he might have gotten, plus interest and probably penalty.

The IRS will probably initially give the deduction and credits to the person whose return gets filed first, because they won't know there's a problem until that second parent's return gets filed -- so it's definitely to your advantage to get your return filed early, before your ex files his.

If your ex does claim your son before you, the IRS will flag your return. You'll have to file a return without your son and then file an amended return with your son. The IRS will then see who is entitled to the claim. If your ex does make the claim first and is found not to be entitled to it, he will have to pay back any money paid out plus interest.

Unfortunately, this process does take some time. Usually at least 8 weeks.
