My exhusband and I take turns claiming our two children on our taxes every year, this is my year to claim them
Therefore I will be getting the stimulus check for our kids. He says there will be another check sent out next year. Is this true? He wants me to split the $ with him and I don't know if I want to do that.

Whoever claimed the children on their 2007 return will get the payment for them. I'm assuming that was you. At this time there are no plans on checks going out next year as well. This is an advance payment on a credit that will be given on the 2008 tax returns. So, next year when it's his turn to claim them, while he won't get a check in the mail... he will receive additional credit for them. AND, YOU won't have to pay what you got as an advance payment back to the IRS. It's like you're both getting credit for the same children, just at different times. Personally I would tell him you weren't going to split it with him because he's going to benefit from it as well when his turn comes around, just not in check form.

Ok here is the deal. I talked to the IRS and since you claimed them this year you will get the early stimulus, but when he claims them next year he will get the money for them too. Because his "situation" has changed. There is no penalty for you, but he still benefits. He just has to wait until he files his taxes next year. Don't give him a dime. The government will give him his share when he's due to get it.

You will get the extra $300 per child since you are claiming them this year. There are no more rebates scheduled next year (and hopefully won't be) so there is nothing to "split" with him next year. You are under no legal obligation to split your tax refunds or rebates with him in any case.

No, not true. For some people who do NOT get a rebate this year (or get less than the maximum) but owe tax next year, there will be some tax benefit from a one-time tax cut for 2008.

You got lucky since this is your year - the money will come to you. You aren't required to split it with him. You can if you want to, of course. If they live with him, or if he does a lot extra for them, that would probably be fair. Otherwise, frankly, I'd keep it.

whoever claimed the children for the tax year 2007 will get the check. If you take turns claiming them..isn't it only fair that you split it with him? What if the shoe was on the other foot?

Since this is a one time payment, as far as we know, how can it be fair not to share the encentive with him. Would he have shared if the payment had been sent out on his year? If we knew for certain there would be another next year...but we do not. Yet, even that shouldn't be a consideration.
In this case, I don't think it is a case of what one wants, but what is right to do. Let next year take care of itself. There will be a different President then.
Also, what kind of lesson/message do you want your children to see and learn.

If he made atleast $3000, then he will get his own check for him. If you have custody of your children, then you should get the money. If you have 50/50 joint custody, then I think the right thing to do is split it. Did you mean that it was your turn for the 2007 tax year? That is what the stimulus check is based on. This is an advance on the one for next year. If you qualify for more, then you will get the rest then....if they overpaid, you get to keep the extra money. They are sending them out early because they believe the economy needs it now.

Whoever claims the children on their 2007 tax form gets the money. I have not heard about any more money next year. I plan on spending our money on my kids. They always need something.

From the way you wrote it, he will get the check.

The stimulus check is based on LAST YEARS tax return, not this years. There has been no word about another check for next year.

The best thing to do would be to take the money that is received for the kids and start a college fund or buy savings bonds in their name.

The money is really for the kids, not each of you.
