Way back in 1994 my father received a letter from the IRS. " "You may no longer have to file with the IRS " He evidently took this to mean he no longer needed to file his taxes each year. However his pension payments increased over the years. He passed away this past April, and now I have discovered this. My mother is still living and receiving his pension, and social security benefits. So I did the natural thing. I filled out her income tax statement. I was happy to find out she was getting money back. What I discovered to my horror was, that my father had stopped filing in 1994 because of that letter. Also, the state of New York for which he had worked, didn't take out any witholding taxes while he was alive. The taxes owed would only be about $300 a year, if that much. However multiply that by 14 and add interest, and you've got a considerable sum. I am at wits end as what to do. Anybody have any advice? |

As a matter of standard policy the IRS will not pursue taxes on income received over 6 years ago if returns were not filed. Although they can go back well beyond that if Tax Fraud is involved the courts have ruled that failure to file is not fraud but is only negligence.
On that basis you should look into tax years 2000 and later and file the missing returns and arrange to pay the taxes due.
If there was a refund due this year it's possible that there could be some due for prior years however you can only collect any refunds for tax years 2004 through 2006. Any refunds from 2003 and earlier are normally lost forever though if your father (and maybe your mother too) didn't have the mental capacity to understand what was going on the IRS might waive that.
The IRS never sends out letters saying that you may never need to file again. Most likely it was some sort of tax kook scam; there are plenty of them about.
It might be a wise idea to consult with a local CPA or EA. This could get messy but you also could get lucky and not be in as bad a mess as you think you are at the moment. |

You mother is an innocent spouse. Call your local IRS office and set up an appointment. Go in and talk about this. I don't think it will be as bad as you think, if your mother would get a refund this year, then chances are great had your father filed he would not have owed either. Good Luck, I really think you are okay on this one. |

The IRS would only go back at most 6 years. However, if you have not found any notices about not filing, it is my hunch that his income was not high enough to have to file. The IRS sends notices to people who need to file. I think that you have nothing to worry about. |

there are more than likely penalties also on top of the interest I would contact a professional from the state the taxes are owed. Also the IRS is very good negoiators they may drop the interest and penalties. They will probally just be happy to get the $$$. Also explain the situation doesnt hurt. |

As a matter of policy enshrined in the IRS manual, they will not solicit more than six years worth of delinquent returns unless there is fraud. Negligence is not fraud.
Call IRS at 800-829-1040 and it can provide you an information returns transcript with all the W-2's and 1099's you have received for the last six years.
If you have a refund due, the return must be filed within three years of the original due date or the statute of limitations for claiming the refund expires. For now, this means returns for 2004 and later.
Similarly, if you have self-employment income, it must be reported within three years of the original due date or the statute of limitations for having your Social Security account credited expires but you will still owe the self-employment tax.
I suspect that if you owe anything, the amount will be low or IRS would have been in contact with you before now.
You mother can file joint returns with your father (alive or not) and you will probably find that is the best alternative.

Consult the IRS directly or a litigating agency. Unfortunately, the government is not going to have sympathy and won't turn a blind eye to ignorance. The money is owed. Now it's time to negotiate how it will be repayed. One lump sum or installments? |
