That depends on whether your state recognizes common law marriage. If it does, then you can file jointly, if it doesn't, you must file as single until legally married.

The only states that recognize common law marriage are: Alabama, Colorado, Kansas, Rhode Island, South Carolina, Iowa, Montana, Oklahoma, Pennsylvania, Texas and the District of Columbia.

You can only file your tax return together (a joint return) if you are legally married.

A few states recognize common law marriage, and in those states a common law marriage is a legal marriage. But in all of them it takes more than just living together for a period of time. Among other things, you have to have presented yourself as married - if you are still calling him your fiance, you aren't. So no, you can't file together.

And by the way, Audrey's list is old - PA for example quit recognizing any new common law marriages a few years ago.

It depends on what state you reside in. if you live in kansas:
Common Law Marriages
A common law marriage is a marriage by agreement of the two persons without any formal ceremony or license. A common law marriage will be recognized in Kansas if the couple considers themselves to be married and publicly holds themselves out to be married and if they are legally eligible to marry. No minimum period of cohabitation is required.

Common Law marriages are subject to the same legal obligations and privileges that apply to marriages with licenses. Once a common law marriage is established, the couple must get a court ordered divorce to terminate the marriage.

You can file as married only if you are considered married in the state you live in. In some states, cohabiting can be regarded as common law marriage, but this isn't true in most states, and even where it is, I suspect 2 years may not be sufficient. You'll have to investigate the law in your state.

If your state recognizes common law marriages and you have a child than yes you can file your taxes together. If not, than you have to file separate.

Judy gives the correct answer above. Even in common law states, there are requirements to being considered married in addition to simply cohabitating.

Based on the information provided, you cannot file as married.

No, your filing status depends on what you were as of the last day of the year. Married, Single, Widowed, Etc.
