No, they cannot hold your W2 for ransom! Remind him that the is a fine of up to $150.00 (per W2) for failure to send W2s by January 31st. There is no exception for employee debt.

You'll have to wait until Feb 15th to call the IRS. They will investigage the matter and you should have your W2 shortly.

Brian G
100% illegal. They are required by federal law to provide W-2s by January 31st. Doesn't matter even if you admit to embezzling 50 million dollars from them.

Mahal
No, it's not legal.

He has to take you to court to get his money.

Erica B
No, it isn't legal. They are required by law to release your W-2's by 1/31 whether they like it or not. You can contact your local IRS office and explain the situation and they should be happy to assist you in obtaining them.

Honesty given here!

Totally not legal! After Feb 15th (they won't accept the request before then) you can contact the IRS to get a W-2. They have the information by that point and they will forward the information to you so you can file.

What does owing them money have to do with W2's? If they paid you a dollar they owe you a W2. They were supposed to send them out by Jan. 31st. You can contact the EDD department of your state and let them know your situation.
