My former emplyer has failed at sending me my w-2 form. Will they let me file so late?
I was told that they will not let me file this late and they are going to charge me with a late filing fee. Who would I complain to about this? She has told me for the past 6 to 8 weeks she was sending it by mail and has failed to do so. So please someone help me.

I just asked one of the accountants i work for yoiur question and he said that the best thing to do is to file as soon as possible. He said that you should have gotten an extension, but if you didn't, you just have to file as soon as possible.

As to who to complain: he siad that the only recourse you have at this point is to send a letter with your tax return stating that "Employer failed to provide a W-2" and send a letter to your employee stating that you will be sending such a letter to the IRS (he also said a phone call to the employee should suffice as well, but i would go with the letter too.) .

As to the late fees:
Sorry, but without an extension you are responsible for the late fees, maybe you can sue her? Not sure about that. Go to a legal forum and ask maybe?

Try this one:

You need to report this former employer to the IRS. Legally, they have to have your w2 in the mail no later than January 31. You should have done something about this back in February! Call the IRS today.
Also, you may get a late filing fee for getting everything in late, but it is better than not filing at all(big no no!).

Buy TurboTax and file your own. There is no penalty for filing late UNLESS your owe taxes. If you are getting a refund, the IRS doesn't care if you don't get your money fast. They just want their money fast.

Best of luck!

Doctor Deth
you should have been asking your employer for it since Feb 15th - call the IRS - she will already get fined $50 for yours being late - if you have a refund coming and don;t owe any more tax - then your return really isn;t late

somanyquestions
By law your employer had until Jan. 31 to mail it.

You should have used your last pay stub to file to get something in on time. You could have amended it later. You will only have interest and penalties if you owe money. If you are getting a refund you are ok. The IRS does not know your deductions and only sees totals. Get it done now to the best of your ability. Now it will have to be mailed. You cannot efile after 4/15

If you owe taxes, you will pay interest and penalty. You should have contacted IRS if you did not get your W2.

Your employer needs to go to jail and you need a calendar

You will have to pay a late filing fee. Maybe you could still file an extension form and pay any estimated tax. I think you could call the IRS and ask. I think their phone number is
1-800-IRS-1040.
Good luck

first of all you need to report your former employer cause it's against the law not to send a w-2, second if you didn't get it approved to file late then yes you will get a pretty heft late charge and there isn't much you can do about it unless you want to just save the w-2 if and when it comes and just file it the same time you file next year and then you shouldn't have a fine. but ask to make sure

Sadly I do not believe you can file past April1 5th. Approach your employer and be firm about why you did not receive your forms. This is unusual and illegal. If you are eligible to file taxes then you should receive and turn in this form. That is unacceptable.
