My girlfriend and I are, obviously, not married. Can we both claim our new daughter for taxes?
We are each filing our own taxes, but the code is a little confusing. Can only one of us claim our daughter, or can we both?

If all 3 of you live together, the baby gets claimed on only ONE tax return. Assuming you both made more than $3400:

1. Figure out if either of you paid more than half of the housing expenses.

2. Try the tax returns as sets.

Set 1. The person who paid most of the bills files HOH and claims the baby, child tax credit, child care he/she paid and EIC. The other person file single, no EIC.

Set 2. Trade the baby to the other tax return. Both returns as single. The return with the baby gets EIC, child care, child tax credit.

Add up the refunds. Whichever combo is higher, use that one.

Only one of you can claim your daughter for the Earned Income Credit. Depending on who should claim her to get the best of this credit is based on each of your incomes. You should go to the IRS.gov website and search for "1040 instructions" and look at page 52 or so for the EIC table. Then look of each of your incomes with one child and see who would get the larger of the credit.
The irs.gov website also has a free tax preparation and e-file if your income is under $55,000.00 you can use this to see how your total refund/tax would be for both of the returns.
It may be that one of you will owe while the other will get a refund.

Only one of you, but you can choose who claims her. Two people can never claim the same dependent.

Only one of you will be able to claim your daughter. If you both claim her the return that gets accepted last with be rejected and will have to be refiled. The best thing to do is whoever makes the most money should claim her. You will get a larger return this way. My boyfriend and I already had to do all this. :0)

You may get a bigger return if you use your girlfriend as an exemption, then you claim your daughter. You can't both claim her. You can go to Turbo Tax and go through all the steps on the free edition before you file to see how to maximize the return.

You can't claim your girlfriend unless you are married. Only 1 of you gets to claim the child.

Yes you both could claim your daughter. One could claim for the Child tax credit which offset your tax and the other could claim for EIC.
