I'm not sure what you mean by "collect his taxes." Do you mean will you be able to get his tax refund? If that's what you meant, then the answer is yes. You'll have to file with your local court system to get them involved, but if you put a lien against his income to get your child support then any tax refund that he has coming should go to you first.
Supposedly, you can do all child support filing without a lawyer, but it helps to have someone else advocating for you. Check the blue pages of your phone book and see if there are any family services agencies that offer this type of help.
Also, try to show some compassion. Is your ex behind in his support because he lost his job or something, or is it just a cases of him being a jackass? Have you tried to work it out directly with him? Maybe he would pay it to you in payments.
You know your situation best though. If you need to go the court route, get yourself some free legal advice. It's out there.

The state should garnish that from his wages or tax return. Go talk to your lawyer; he or she will probably tell you to file for it in family court. |

You've got to start leaning on your case worker. Let them know that he is delinquent and that you depend on this income to support your child.
During that call I would inquire as to the likely hood of his tax return being diverted.

If your child support order is thru the state district attorney's office, then yes, the IRS will double-check for any outstanding arrears on child support. If it is shown, they will send the monies to the DA's office and then send you a payment. |

I had the same thing happen to me, only he was $3,500 behind. So I contacted my child support office and they notified the government and the government flagged his SS#. So when he filed they knew that he owed and they took some of his return. According to my office in NH, they have to flag it by September in order to get the return. So I would check with your local office. For my case they flagged him in September 2006 and I got some of the money in April 07. Also if he is remarried and they file a joint return you may have to wait longer for the money. My ex got remarried and they held the balance for 6 months. I hope this is helpful! |

You should file a claim with the court or recovery services- the department of Family Services should be able to point you in the right direction.
Recovery Services is the most common place I have heard to get child support- they will garnish his wages and attach his tax returns. And if he quits a job, they will just keep the tab running, he can't just quit working so he doesn't have to pay child support. I think they flag his SSN so that they can see when he gets a new job. My sisters have used them and they seem to like them. They do all the work. |

If the agency he is supposed to pay the child support through has filed the proper paperwork with the IRS, his back support amount would be deducted from his refund if he has one, and sent to you. |

of course, that takes hearing in family court [or whatever it is in your jurisdiction] and to get that you have to file a petition claiming non-payment ... and I think there's a fee you have to pay, too.

I'm not sure where you are from, but where I live, if your husband or whoever has not paid child support they will suspend his license and garnish his wages. See a lawyer or bookkeeper if possible |
