Several people have hinted at the valid choices:
1. File MFJ. Claim your exemption on that return. You and your husband can make up to $17,900 before you will owe any tax.
2. File MFS. Your husband can make up to $8950 before he would owe any tax. If he makes more than that, MFJ is a better choice.
3. If your husband files MFS, your mother would still have to show that she provided more than half of your support. That would be difficult, but if she did, she'd get to reduce her income by $3500 and wuold save maybe $350 in tax. (Since you lived with her for LESS than 6 months, you do not qualify her for HOH, EIC or child tax credit.)
If their incomes are equal, what your mom would save in reduced taxes is roughly what your husband would pay in additional taxes. So I'd say, file MFJ. |

You have no choice. You have to file as married. It's your status as of December 31 that determines how you file. It doesn't matter whether you were married or single for any other part of the year. |

You just lived with your mom for 4 months, so she can't claim you as a qualifying child. If you made under $3500 for the year, and she provided over half of your support for the year, and you do NOT file a joint return with your husband, she can probably claim you, but can't if you don't meet ALL of those rules. You and your husband would file as married filing separately if she claims you and you and/or he file a return.
It's highly doubtful that your friend is right about getting $3000 if you file a joint return, but if your husband has any tax liability at all, filing a joint return would lower his tax bill. |

Your mom only had you for 4 month of the year, that is less than half. In order to claim you, she needs to have paid the majority of your expense for the year. She will not qualify to claim you.
File a joint return with your husband. |

Technically, you cannot be claimed as a dependent because you do not meet the dependency rules. You're married now - you and your hubby should reap the tax benefits - not your mother. |

When "friends", "them" and "they" hand out free advice take it for what it is worth. You need to get Pub 17 at the free forms site at IRS.GOV and work through the flow charts to see which way to go. Depending on circumstances it is possible for either your mother to claim you or for you to do a married, filing joint return. |

people do not always know your situation.It depends if he makes x-amount of dollars and have nothing to claim.HE CAN CLAIM HEAD OF HOUSEHOLD,and get the bigger returns.BUT the right way is to claim married and claim you and the child as dependants,if child was born in this year.it also depends on the amount you made before you went on FAMILY LEAVE....DON'T LISTEN TO HEAR-SAY UNLESS BECAUSE YOU PROBABLY DID NOT EXPLAIN THE WHOLE STORY TO THEM-YOUR BUSINESS |
