My husband owes on a student loan and they threatened to take it out of our income tax...My ? is..?
We can't afford to pay it off right now(due to debt) and when they told us this he had a different job at the time. Since then we have moved and his job has changed and they have no idea where he is and where he works. A student loan is the one loan you can never get out of, not even filing bankruptcy can get you out of a student load. So yes they can garnish wages or tax refunds too get what you owe. Your social security number is how they track you and when you file your taxes then they know exactly where you are. Call them and see if you can negotiate affordable payments the more you avoid them they might increase penalties and thus more money.

They sure can - his address might have changed, but his social security number is the same and that's what's used to track people, and to identify the return to take it from.

they can and will garnish your refund check - they don't need to know anything more about you than the fact that you have money coming back to you that you owe to them.

Yes they can still take it. It's the IRS that flags your return, not your employer.

You had best contact the loan agency and work out a repayment plan. This will not go away - EVER! And yes, they don't need to know his employer, they can just tell the IRS not to send you your check.

They will take the refund and apply it to the student loan. You however can file as an injured spouse and they will only take the part of the refund that would be his.

I agree with the post about knowing where you work via the ssn.

Unless you live in a state that limits certain garnishment orders, they can not only deduct the amount from your joint return, but can also get it form his paycheck or pur a lien on your property or bank accounts.

Report them! It is illegal for them to threaten you by saying they will garnish wages, or anything like that. That can only be done court-appointed and its a long procedure for that to happen.
