littlemamma81 | My husband returned to work this week and will get his first paycheck next friday...Can he claim unemployment? |
this Sunday, because wouldn't that be the payment claim for the prior week off? |
|

Caveat Emptor
|
No. The day he returns to work, he ceases to be eligible for unemployment. Payday dates are not a factor. |

The claim this coming Sunday is for this current week. NO he can't get unemployment for this week, he's working, even if he doesn't get paid until the following week. |
|

Bash Limpbutt's Oozing Cyst©
 |
NO! What he will file this Sunday will cover Sun - Sat of the week immediately ended. If he worked that full week he should NOT file a claim at all. (Not filing claims will automatically close his claim.) If he worked less than the full week he should file the claim and show his earnings for the week, even if he has not been paid yet. |

Your wording is a little confusing.
If your husband was not working the week of 5/16-->5/22, he can call in the claim for that week starting on Sunday, 5/23. So if he has yet to call in that claim, yes, he can.
Say your husband went back to work this Monday, 5/24. He cannot call in a claim on Sunday, 5/30, that would be saying that he didn't work in the week of 5/23-->5/29 . . . which he did. |
