My husbands ex filed a joint tax with him?
My husbands ex for the past two years not including this current year has filed a joint tax with him while he has been finling single or like last year filed joint with me. We found this out when he went to court for child support. Now my question is can he get in trouble for this? She did this without him knowing and let me tell you she is very shady and loves to take money that is not hers. She is currently recieving wel fare while her now current husband is bringing home roughly 4000 a month and her mother and father support her.

How did she get his financial information and copies of his W2's?

When I was separated, but not yet divorced, my ex filed separately and itemized his deductions. This meant that I couldn't legally take the standard deduction. I had to itemize too ... even though I didn't have anything to itemize. Basically, he screwed me over.

Was your husband married to his ex for any portion of 2007? If not, I doubt that what she did was legal. I think your husband needs an accountant at the very least and, perhaps, a lawyer.

if he can prove he didnt sign the return then you are ok, she is in trouble since both of them need to sign to complete the return...he/she is a fraud!!!

You can file a joint return until the divorce is final even if you are living separately. After that each person is single again.

make an appointment to speak with soeone at the IRS. Your husband did absolutely nothing wrong...butt he needs to explain the situation before a "red Flag" pops up on you tax info. No big deal..just do it! ♥



Divorced or separated spouse. If he/she obtained a final decree of divorce or separate maintenance by the end of the year, you cannot take your former spouse's exemption. This rule applies even if you provided all of your former spouse's support.

Exemptions for Dependents
You are allowed one exemption for each person you can claim as a dependent. You can claim an exemption for a dependent even if your dependent files a return.

The term “dependent” means:

A qualifying child, or

A qualifying relative.

Each state has there own hot line you can call locally or contact the IRS hotline for further support. Good luck.

If she filed a joint return with your husband then when he filed a single return it would of red flagged his return, how can she file a joint return, without his W2 information?
Have him contact IRS, you can't call you won't be given information on his account. HE can asked a IRS agent if his SSN was used on another return, or he can go to the Local IRS office in your city for assistance.

You should call the IRS hotline number to report her for tax fraud. And, call your state/county welfare department to report her for welfare fraud.

As long as he just learned of the IRS fraud, which can be documented by the recent child support court case, and he never signed the fraudulent tax returns (which means she forged his signature) he will be fine with the IRS. But, it's time to review his tax returns for those years in question, because if she filed them earlier than he did, the IRS should've caught an irregularity, when they received his, and vice versa. I'd also call your local police department to ask them if they will take a report, which they will do, if the crime (forgery) occurred in their jurisdiction. Expect them to refer you to the IRS for the tax fraud issue.

P.S. I just read your additional details, saying they were never married. In that case, it was illegal for them to file a joint return. The IRS filing status instructions are very clear, and can be found at http://www.irs.gov.
