I've been working at my job since August 2007 and getting paid bi-weekly. I filled a W2 form but i notice that taxes was never taking off my paycheck and now I end up paying over $3,000 this year. I asked my boss why he doesnt take anything off, but he keeps saying that he paying under the table by check. I'm still working at the same job at this moment. What should I do to avoid paying lots of money for next year taxes?? is my boss ripping me off?? |

Yes your boss is ripping you off. He is paying you illegally to avoid paying the employer taxes he owes for you for his half of social security and medicare, unemployment comp and workers comp - so you aren't covered for workers comp if you get hurt or by unemployment if you get laid off, and you are having to pay twice as much for social security and medicare. |

Sounds like you are saying that you weren't aware that he wasn't taking taxes off. Don't know how that's possible because you would have known how much he was paying you per hour or for salary and when the cheques were not less than what that would be, it should have tipped you off. An employer needs to provide a stub when they pay and take taxes off and since you weren't getting one, that would be a tip off as well. Now, you aren't an employee in the case when they don't take taxes off, what you are is a contreactor. It is your job to put aside a reasonable amount of money each paycheck for taxes. You could probably find out from the government and submit it regularly through the year or simply keep it in a savings account collecting interest and then once you do your taxes you can write a check for what you owe. They aren't ripping you off, but they aren't paying you under the table....they can only do that with cash. Don't go based on him saying it is under the table and then not declare the money. You could find yourself in a heap of trouble if you do that. |

I could be wrong, but I always thought that paying under the table was done in cash so no paper trail was left? But, that still doesn't make it right because you would also have to lie and not report those earnings on your income tax return. He is supposed to report all your earnings to the IRS. Something is most definitely wrong in this case. Maybe you should contact the IRS and explain your situation? But then again, maybe not. Is there any way you can get another job with an honest employer, and move beyond all this mess once and for all? That may be your best bet. |

To protect yourself, you should make quarterly estimated payments. There are forms you can download to do this. If you don't, you can get penalties above what you would normally pay in tax. If you pay too much on your estimates, you will simply get that back as a refund. |

Your not at fault or trouble here. Hes paying you " under the table " and thats fine and legal. I really doubt HE'S paying taxes. Federal or State. He probably does not have a buisness license which may and probably is illegal. Your fine legally but if you want to work there you willl just have to budget that in . Set aside about 25 to 30 percent for April 15th 2009. You could ask him to take out taxes but I guarantee he wont because he doing something illegal here and " he who rocks the boat " can be fired. If you are ever fired though you have him in a VERY bad situation and he knows it. Dept of labor or the local tax office would be all over him. |

That is his way of working around the law. If you have filled out a W2, those should be taken out. It is his job to report it to the IRS. He could get in big trouble for this. I would consider either telling him this, or find another job. |

You can't avoid paying lots of money next year, what you need to do is put a portion of your check away to pay the taxes so you don't get hit so hard at the end of the year. You can put it in a high interest savings account so you can earn some money on it. |

yes your boss can do that however you should have had to sign a paper for taxes... im in the same boat its some kinda tax thing for under 30000... ive been looking for the document i signed but i cant find it yet |
