If he pays his child support through the state, then yes they can garner his tax refund if he is in arrears. If he pays you the support directly they won't unless you have the courts file a judgement against him to have the refund garnished.

But, if he and his new wife file a joint return, she can claim "innocent spouse" and have part, if not all, of the refund protected as hers and not his.

Have you contacted DHS recently? The squeaky wheel gets the most action. Yes the IRS can take out of his part of the tax refund for arrearage of chid support. But if you have been receiving state welfare goes to them, not to you, until state welfare has been paid back what they gave to support your children.

Here are some great links to give you all the information you need and yes, he will have to pay somehow some way in the long run, but if you get help from the state child support division, they will have any and all access to gain that money for you. GOOD LUCK, I KNOW YOU WILL GET WHAT YOU DESERVE!! I didn't on my first because the asshole got paid under-the-table jobs to purposely skip any payments for all of his kids and he has 8 from 8 women now and has only paid child support for the 1 before my daughter with him and then moved back in with that one to skip payments yet again. He thought he was a player and now regrets all of it when she is now 18, living with her boyfriend and they are having my first grandson 2 days before my 4th baby, with a decent man, but my 2nd and 3rd babys daddy I married and he's very responsible , we just grew apart. Sorry thought I might share a little with you.

If the proper paperwork has been filed by the agency that handles his support payments, then most likely yes.

In the State I live in, the person that is owed the support has to file a paper with Department of Health and Human Resources, Child Support Division, to have it taken from his Federal Tax Return. I have heard of it taking two years from the time of filing the paper to get the return, I don't know why unless it takes time to get in aggreement with the IRS. God Bless!

They should, but it's not that simple. I've been researching how to get my ex to catch up what he owes, but with little luck. I'm sorry I can't remember what I found out last year, but it wasn't as promising as I'd hoped. There are always things that you don't find out until later.

Not trying to be depressing, but I haven't found a simple solution yet. Hopefully, you'll get a response from someone here who has actually been through the situation, not from "a friend I used to know" or "this guy's ex wife told me."

MoB, I am sorry, but you have no idea what you are talking about. There is a well known law in place that the child comes first. What ever is left over goes to the state. I know this for a fact because Im in that situation.
