My 16 year old sister was paid cash for babysitting for us this summer while we worked. Can I claim the $2500 we paid her as a Child Care deduction on my taxes? Also, will she have to claim the $2500 we paid her (this was her only income)? If so, I assume this is called "earned income", correct? |

LEGALLY she is required to file an income tax return because she had more than $399 in self employment earnings. She will not have to pay federal income tax on the $2,500, but she WILL have to pay self-employment tax on it. That covers her social security and medicare liabilities.
So long as your sister is not your dependent, you can claim the $2,500 as a dependent care credit. You must use Form 2441, or schedule 2 of form 1040 to report her name, address, and Social Security Number. |

If you are claiming the deduction you will be prioviding the irs with her income and social security number, so she in turn needs to claim it, or your parents on their return as she is their dependent. If she was a good sitter for you and because she is your sister you might consider not claiming it yourself, and then no one claims it. |

Do not do this! She will have to PAY taxes on the money that you gave her if you do. And since I have a 16 year old sister I will asssume that the money is already spent. If you wanted to pay her with taxes then you should have taken the taxes out for her. This is what people that have nannies do. |
