My mom is my child care provider can i claim the child tax credit?
Both of my kids go to school in the morning and get out at 11:00, my mom then picks them up and cares for them and I give her some money in return, can I claim that in my taxes as child care? And if so, does she also have to claim them in her taxes? She doesn't work, but gets payments from taking care of a foster child, does that matter?

Yes, you can take that as a Child Care Credit. You will have to show who you paid by name, address and social security number so the IRS can check to make sure she declared that income, which is the answer to your second question. It does not matter that she is also a foster parent.

You can claim the money you pay her, but then she will also have to claim that income in her taxes.

You claim the child tax credit. If you claim her as a person providing child care she will owe taxes on the amounts you paid to her. She will also have to report this as income. She is actually babysitting. She doesn't have a business. She also would have to claim income from the foster-childs parents.

Yes you can take the child care credit but you will have to report her SS number on your form. She will have to file Schedule SE with her 1040 and pay some social security taxes even if she has no regular income tax. Her foster child payments are not taxable to her. Her SE tax rate will be 15.3%. Your child care credit will be 20 to 35% of what you paid her. If she gets aggravated you could pay her tax and keep the rest of what you saved.

if you claim the deduction - she has to claim the income (and list her name and soc sec # on your return so the IRS can check to see if she claims the income) and it will cost her more in taxes than it save you

This is a common situation.

Assuming that your mother is not claimed as a dependent on your tax return, then you can claim the dependent care credit for the money you pay her. You will need to report her name, address, and social security number on form 2441 as the provider of the dependent care services. If you mother is required to file a return, she must report the income you pay her. If you pay wages in excess of $1700 in the year to your mother to care for your children, then you need to pay social security and medicare taxes on what you paid her by completing and attaching schedule H to your tax return and issue her a W-2.
(Note that wages paid to a parent are usually exempt from Social Security and medicare, but not if the wages are pay for the care of your child)

It doesn't matter that she is a foster parent receiving payments for this.

no.. i'm sorry you cant... unless you want to provide your moms ssn to the irs and have her claim the income and pay taxes on it then you cant.

@Kandy - I pay my mother to watch my children... what's wrong with that? I'm sure it's very common actually. Thank you to everyone else for your responses. This was helpful to me as I prepare my own taxes.
