My mother claiming my child on taxes.?
My mother lived alone last year and all of last year was helping me and my husband pay for our bills and mortgage and clothes and food for my children while my husband was layed off. I told her she could claim my oldest son as a dependent for all the money she has spent. She wants to make sure its legal to do that and was wondering if she can file head of household to. Unless your child lived in her home for more than half of the year, she can only claim your son under the Qualifying Relative rule if you and your husband each had less than $3,500 in income and do not claim the child for ANY purpose, including claiming the EIC. She would also have to have provided more than half of the child's entire support for the year.

To file as HoH she would have had to have paid more than half of the cost of maintaining the home where the child lived, i.e. YOUR home, so it's highly unlikely that she can file as HoH.

In the circumstances described it's highly unlikely that she can claim your child and even less likely that she could file as HoH.

Your child is not the qualifying child of your mother since the child did not live with your mother.

Your mother can claim your child as a qualifying relative if

1. Your child had income less than $3,500
2. Your mother provided over half the child's support
3. Your child is not the qualifying child of anyone

If you lived with your child for over six months, your child is your qualifying child.

So, very unlikely that your mother has any claim on your child. This includes the exemption, credits, and head of household filing status.

Slightly possible. If the 4 conditions for dependency are met, but if she can take him, you could not take him. Ask the IRS or look up regulations online for claiming a dependent.

The circumstances you describe would not allow her to claim the child and if that is the only dependent she would have she could not file as Head of Household.

Your mother is not head of household as she lived alone.
You child is your qualifying child so the child can not be dependent of your mother.

instead of the hassle, why don't you just file your kids, then give her some money out of the taxes. Be a lot easier.

Has she spoken to a tax expert?
How will she justify filing as head of household?
Do you live nearby whereas your son could have lived and attended school from her house?

No. What she was doing is gifting you money. That does not give her entitlement to claim your child or file as HOH unless the child lived with her.
