The taxes plus any other debts she owes must be paid to the extent there are assets in her estate before the heirs are paid anything. If there is nothing left, any remaining debts, tax or otherwise, will be noncollectable. I can't tell from your question if anything could be done to resolve the tax problem now.

It is the same nationally. Her estate pays any back taxes or other debts due. If there is not enough in the estate, then the debt holders, such as the IRS, do not get paid back in full. Under no circumstances can they come after you. Of course, in this case, you will not receive anything in the will. |

You do not inherit your mother's tax debt. However, the taxing authority is going to be paid before you inherit anything.
So, her estate is the entity that owes the tax, and the estate will (in theory) pay any tax due before distributing any assets to the heirs.
If you take possession of her assets before the state has received the tax due, then you will be liable to the state for the tax owed, up to the value of the property you inherited. |

The estate will owe the tax, so whatever she leaves up to the amount she owes in back taxes would go to PA rather than to you. If she doesn't leave that much, any extra is cancelled. |

I know it's screwed but her estate will owe them and if your the head man of the estate it will be you. Sucks to know that when you die you still owe the government. I mean after all if it wasn't for us working law abiding tax payers, who would buy all the cigarettes to the capable yet lazy pricks who don't want to work? |
