my x did not file last year because he owed money. I filed and got my refund. We are still legally married (serperated 5 yrs.) and I want to make sure this is taken care of this year so I don't get screwed. Will this come back on me? I told him we would file separately. He can claim one of the kids this year and with the refund we will pay off last year. Whatever is left I get. Will this work or is he screwed from not filing last year? |

If you are not living with him and support your own household, his tax liability is not your problem.
If I am interpreting this correctly, you are letting him claim one of the children that lives with you. If you "let" him claim the child as living with him, you may be setting yourself up for some trouble if this is not true. So don't do it.
If you want to allow him to claim a child, sign Form 8332 waiving your exemption for your child to him for 2007, but also documenting that you are the custodial parent. Form 8332 will allow him the exemption and the Child Tax Credit. It will not give him the Earned Income Credit or allow him the Head of Household filing status.
There will not be a problem for you if in fact you are not living with him and your returns are filed properly. |

Not your problem. Check out the advice about filing as Head of Household. You could generate a significant additional refund to yourself. |

He can still file his last year's taxes. If your kids lived with you for six months or more and you provided half of their care, you can claim them. He can't. Since you filed separately, you should have no problems. Depending on your income, you may qualify for EITC. You might also be able to file as head of household (much better than MFS) |

As long as you file separately you have nothing to worry about. (And it's not your problem anyway so there's nothing that you can really do about it.)
Giving him one exemption for one of the kids won't make that much difference on his tax return for this year. It will reduce his tax by betewen $340 and $1,190 at the most. For most taxpayers it's worth $850 at best unless his income is unusually high. Assuming that you are the custodial parent he can't claim the EIC or file as Head of Household if you give him one of the exemptions -- you will still get those -- but it will make you look good as far as he's concerned so it might be worth something there. |

If you filed your return as Married Filing Separately or Head of Household, since you didn't live with him at all last year, you're okay and it's all on him for last year. Let him worry about it. |

Your x will need to file the 2006 tax return. IF he files his 2007, IRS will hold his refund until his 2006 is filed. Once 2006 is received and full processed if he owes his 2007 refund will be offset to pay the balance owed. If it full pays the balance the difference will be refunded to him.
Him not filing should not affect you. |

She can't claim HoH since she is still married. If the kid lived with you all year then your X can't claim him. Unless you don't claim your kid and let him but that would be fraud. It is his debt not yours.
He should pay his taxes on time I am sure he owes much interest from not paying the IRS over the year. Good move leaving him.... If he doesn't know to pay his taxes or avoids it then he's not the type of person you want to be with and have raise your kid! |

No he is not screwed from not filing last year. IF you owed anything last year that will come out of this years anyways but, you should file them together at the same time. You always have a year grace period before you absolutely must do your tax returns. |
